RESOLUTION OF THE COUNTY OF BUTTE ANNEXING TERRITORY TO COUNTY SERVICE AREA N0. 104 - BLACK OAK (RIVERBEND SUBDIVISION) WHEREAS, Nebhut Smith has petitioned the Local Agency Formation Commission for inclusion of his parcels ..within County Service-Area No. 104; and WHEREAS, the Butte County Local Agency Formation Commission has approved this annexation and designated it: 88-3 - Annexation to CSA ~~104 - Riverbend Subdivision, the exterior boundaries of which are described in Exhibit "A" attached hereto and made a part hereof by this reference; and WHEREAS, the Butte County Local Agency Formation Commission has duly approved and authorized the Board of Supervisors to annex such territory without notice and hearing by the Board and without an election; and WHEREAS, the territory is uninhabited; and WHEREAS, the reason for this annexation is to provide storm drainage maintenance and street lighting. NOW, THEREFORE, BE IT RESOLVED that said territory described in Exhibit "A" described as 88-3 - Annexation to GSA ;'1104 - Riverbend Subdivision, is hereby annexed to and included within the boundaries of County Service Area No. 104. BE IT FURTHER RESOLVED that said territory shall be taxed to pay any indebtedness or liability of County Service Area No. 104 prior to or existing at the time of annexation. PASSED AND ADOPTED by the Butte County Board of Supervisors on this 16th day of August 1988, by the following vote: AYES: Supervisors Dolan, Vercruse and Chairman MCInturf NOES: None ABSENT: Supervisors Fulton and McLaughlin NOT VOTING: None HASKEL A.
