HomeMy WebLinkAbout88-130COLLECTION FEES FOR COURT ORDERED RESTITUTION AND FINES WHEREAS, Penal Code Section 1205 allows for a fee to offset the costs of processing installment accounts involving court ordered fines; and WHEREAS, Penal Code Section 1205 allows the amount of this fee to be determined by the Board of Supervisors, except that such fee shall not exceed thirty dollars ($30.00); and WHEREAS, Penal Code Section 1203.1 allows for a fee to cover actual administrative costs involved in collecting court ordered restitution; and WHEREAS, Penal Code Section 1203.1 has been amended to require such fee to be set by the Board of Supervisors, except that such fee shall not exceed ten percent (10~} of the total amount ordered to be paid; and WHEREAS, it has been determined by the Board of Supervisors that such administrative services are necessary and justifiable. BE IT THEREBY RESOLVED that pursuant to Penal Code Section 1205(d) the Board of Supervisors have determined and do hereby order that the fee for processing installment accounts involving court ordered fines of one hundred dollars ($100.00) or less shall be ten dollars ($10.00); and all installment accounts involving a fine of one hundred and one dollars ($101.00) or more shall include a processing fee of thirty dollars ($30.00); and BE IT FURTHER RESOLVED that pursuant to Fenal Code Section 1203.1 the Board of Supervisors have determined and do hereby order that the fee for collecting restitution shall be ten percent (IOgo) of the total amount ordered by the court to. be paid.
