RESOLUTION OF THE BUTTE COUNTY BOARD OF SUPERVISORS GIVING
NOTICE OF A PROPOSAL TO AMEND RESOLUTION NO. 87-269 TO STATE
TO STATE OF PURPOSES OF THE BERRX CREEK COMMUNITY SERVICES
DISTRICT, FIXING TIME AND PLACE OF HEARING OF PROTESTS AND
DIRECTING THE GIVING OF NOTICE THEREOF
WHEREAS, On November 17, 1987 this Board adopted its
Resolution No. 87-269 authorizing the formation of and
establishing the boundaries of the Berry Creek Community Services
District:
WHEREAS, Government Code Section 61127 requires that a
Resolution authorizing formation of a community services
district, among other things, set forth the purposes of the
district;
WHEREAS, Resolution No. 87-269 failed to state the
purposes of the Berry Creek Community Services District;
WHEREAS, the District has requested that the Board of
Supervisors correct its Resolution No. 87-269 to state the
purposes of the District to include those set forth in
subsections (a}, (f), (j) and (k) of Government Code Section
61600; and,
WHEREAS, upon the District's application, on May 5,
1988, the Butte County Local Agency Formation Commission adopted
a motion authorizing and recommending the statement of purposes
of the Berry Creek Community Services District to include those
set forth in the aforesaid subsection of Government Code Section
61600.
NOW, THEREFORE, be it RESOLVED by the Board of
Supervisors of the County of Butte, State of California, as
follows:
1. That Tuesday, the 1st day of November , 1988,
at the hour of 11:00 am in the Board of Supervisors Chambers of
the Butte County Administration Building, 25 County Center Drive,
Oroville, California, is hereby fixed as the time and place for
hearing of written protests against the adoption of a statement
of the purposes of the Berry Creek Community Services District,
to state the purposes set forth in subsections (a) , (f) , {j ) and
(k) of Government Code Section 61600, namely:
(a) To supply the inhabitants of the District with
water for domestic use, irrigation, sanitation, industrial use,
fire protection, and recreation.
(f) Street lighting.
(j) The opening, widening, extending,
straightening, surfacing, and maintaining, in whole or in part,
of any street in the District, subject to the consent of the
Board of Supervisors of the County of Butte.
(k) The construction and improvement of bridges,
culverts, curbs, gutters, drains, and works incidental to the
purposes specified in Subdivision (j), subject to the consent of
the Board of Supervisors of the County of Butte.
2. That at said hearing written or oral protests
against the adoption of said statement of purposes of the Berry
Creek Community Services District will be considered.
3. That the Clerk of the Board of Supervisors is
hereby directed to give notice of the time and place of hearing
as provided by Government Code Sections 61105 and 6066.
PASSER AND ADOPTED by the Butte County Board of
Supervisors this 4th. day of October 1988, by
the following vote:
AYES: Supervisors Dolan, Fulton, McLaughlin, Vercruse and
Chairman McInturf
