RESOLUTION OF THE BUTTE COUNTY BOARD OF SUPERVISORS
DEEMING GENERAL FUND AGENCIES OF THE COUNTY OF BUTTE TO HAVE PAID
SHERIFF' S CIVIL FEES IN ADVANGE OF SERVICE ___~...
WHEREAS, Assembly Bill 1389 has amended Government Code Section
6103.2 to authorize the Sheriff, Marshal or Constable, in connection with
service of process of notices, to require of all public agencies and grivate
persons or entities prepayment of fees for said service; and
WHEREAS, such authority does not apply to a particular jurisdiction
unless the Sheriff imposes a requirement of prepayment upon public agencies
and upon all persons or agencies within the private sector; and
WHEREAS, requiring general fund agencies of the County of Butte to
prepay such fees would increase administrative costs and would not increase
revenues to the County;
BE IT RESOLVED that the general fund agencies of the County of Butte
are hereby deemed to have paid to the Butte County Sheriff all fees which the
Sheriff is authorized to charge pursuant to Government Code Section 6103.2.
PASSED AND ADOPTED by the Board of Supervisors of the County of
Butte, State of California on October 18, 1988, by the following vote:
AYES: Supervisors Dolan, Fulton, McLaughlin, Vercruse and
Chairman McInturf
