HomeMy WebLinkAbout88-170 `~`'' v. -.~.wv^~.. ...,..~--r. .v v..~v '~~ n` ~ " *~ COUNTY OF BUTTE, STATE OF 'CALIFORNIA ,y: ~: ~ 7~ .., Resolution No. sg- 170 RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF BUTTE AMENDING ITS RESOLUTION NO. 87-269 TO STATE THE PURPOSES OF THE BERRY CREEK COMMUNITY SERVICES DISTRICT WHEREAS, this Board of Supervisors' Resolution No. 87-269, adopted November 17, 1987, authorized the formation of and established the boundaries,of the Berry. Creek Community Services District; and WHEREAS, Government Code Section 61127 requires that a Resolution authorizing formation of a community services district set forth the purposes of that district, but Resolution 87-269 inadvertently omitted a statement of the purposes of the district; and WHEREAS, the Berry Creek Community Services District has 2,. applied for an amendment of Resolution No. 87--269 to set forth a statement of the purposes of the District; and cc WHEREAS, upon the District's application the Butte County .F- Local Agency Formation Commission, on May 5, 1988, adopted a N coo motion authorizing and recommending a statement of purposes of c.n the Berry Creek Community Services District to include those purposes set forth in subsections (a), (f), (j) and (k) of Government Code Section 61600 et seq.; and WHEREAS, on October 4, 1988 the Board of Supervisors adopted Resolution No. 88-142 directing that notice of hearing of the District's application be given as required by the provisions of Government Code Section 61000 et, seq.; and WHEREAS, the Board, on this 1st day of November, 1988 at the hour of 11:OOam, conducted a public hearing on the proposal to amend its Resolution No. 87-269 to state the purposes of the Berry Creek Community Service District; and WHEREAS, the Board, based on the evidence presented, has determined that the purposes of the Berry Creek Community Services District should be stated and that they should include 94-28751 those set forth in subsections (a), (f), (j) and (k) of Government Code Section 61600. NOW, THEREFORE, be it RESOLVED by the Board of Supervisors of the County of Butte, State of California, as follows: 1. The Board of Supervisors of the County of Butte hereby declares that the purposes of the Berry Creek Community Services District are those set forth in subsections (a), (f), (j) and (k) of Government Code Section 61600, namely: (a) To supply the inhabitants of the District with water for domestic use, irrigation, sanitation, industrial use, fire protection, and recreation. (f) Street lighting. (j) The opening, widening, extending, straightening, surfacing, and maintaining, in whole or in part, of any street in the District, subject to the consent of the Board of Supervisors of the County of Butte. (k) The construction and improvement of bridges, culverts, curbs, gutters, drains, and works incidental to the purposes specified in Subdivision (j), subject to the consent of the Board of Supervisors of the County of Butte.
