AN ORDINANCE OF THE COUNTY OF BUTTE ADOPTING BY REFERENCE
THE UNIFORM BUILDING CODE, 1964 EDITION, !WITH APPENDICES
THERETO AS PREPARED AND PUBLISHED BY THE INTERNATIONAL
CONFERENCE OF BUILDING OFFICIALS PROVIY3ING FOR THE APPLICA-
TION QF REGULAT39NS THEREIN CONTAINED TO THE UNINCORPORATED
AREAS OF THE COUNTY OF BUTTE AND PRESCRIBING PENALTIES FOR
THE VIOLATION THEREOF.

The Board of Supervisors of the County of Butte do ordain as follows:
SECTION I (.Purpose)
in order to provide minimum standards for the proper regulation of building
construction, the Uniform Building Code, 1964 Edition, with appendices thereto,
prepared and published by the International Conference of Building Officials,
is hereby adopted, incorporated, and made a part of this ordinance by reference
without further publication as though set Earth at length herein and is hereby
declared to be the Building Code for the County of Butte and shall apply to and
govern all building construction in the unincorporated areas of the County
except as hereinafter provided.
SECTION II (Definitlnns)
Whenever any of the following names or terms are used in said Uniform
Building Code, such name or term shall have the meaning ascribed to it by this
section as follows:
1. "Building Official" shall mean the Director of Public Works of the
County of Butte.
2. "City" shall mean the County of Butte when referring to a political
entity or an unincorporated area of said County when referring to
said area. .
3. "City Clerk" shall mean County Clerk. "Ex-officio Clerk of the Board
of Supervisors" shall mean County Clerk.
4. "City Council" shall mean the Board of Supervisors of the County of
Butte.
Sp "Housing Act" shall mean the State Housing Act .(Section 17910 et sec.,
of the Health & Safety Code of the State of California).
6. "Mayor" shall mean the Chairman of the Board of Supervisors of the
County of Butte.
SECTION 2I2
This ordinance shall constitute such an ordinance as is referred t~,in
Section 17951 of the Health & Safety Code.

1 SECTION IV (Appeals Board}
2 Section 204 of said Uniform Building Code is hereby deleted. The Local
3 Appeals Board of the County of Butte which was established by Resolution
4 No. 64-3 by the Butte County Board of Supervisors shall hear any and all appeal
~ regarding the applicatian and enforcement of this ordinance.
g SECTION V (Fire Zone 3)
ry i'~u'suant to Section 1601 (a) of said Uniform Building Code, all of the
g unincorpaxated areas of Butte County are designated for the purposes and within
g the meaning of said Section as Fire Zone Three (3),
ZO SECTION VI (Exemptions
11 Add to sub-section (a} of Section 301 of said Uniform Building Code, the
12 following paragraphs:
13 No permits shall be required for any agricultural building or structure.
14 Agricultural buildings are defined as follows: "Agricultural building is a
15 building lacated on agricultural property and used to shelter farm implements,
16 hay, grain, poultry, livestock, or other farm produce, in which there is no
17 human habitation and which is not }used by the public".
lg No permits shall be required for small unimportant detached structures,
19 i.e., tool sheds, wood sheds, and work shops with a total net area including
20 additions of less than 200 square feet and whose occupancy would be classified
2I as Type Jas defined in-the 1964 Uniform Building Code as published by the
22 International Conference of Building Officials, except that this exemption
23 shall not apply to laundry buildings, bath houses, carports, and garages.
24 SECTION VII,(I'ermit Expiration)
25 Section 302(d) of said Uniform Building Code is deleted in its entirety
28 and is amended as follows:
27 Every building permit issued under the provisions of this Code shall
2$ expire by limitation and become null and void after one (1) year from the date
29 of issuance of said permit. If building is under cgnstruction, before work can
30 continue, a new permit shall be first obtained and the fee tizerefor shall be
31 one-half (1/2) the amount required for the ariginal permit; provided, no
32 changes have been made or will be made in the original plans and specifications

1 for, such work. If the building work authorized by a building permit is not
2 commenced within sixty (b0) days from the date of issuance, or if the building
3 or work authorised by such permit is abandoned or suspended at any time after
¢ work is commenced for a period of one hundred twenty (120) days, permittee
5 shall so advise the Building Tepartment. Before suck work Can be recommenced,
6 the Building Department shall be so notified that work is to proceed and the
7 building permit must be active.
g If the construction has not begun within the one (1) year period, the
g permit becomes null and void and a new permit application and a full permit
10 fee must be paid to reinstate the permit.
11 SECTION VIII (Plan Checking)
12 Section 303 (b) of said Uniform Building Code is hereby amended to exclude
13 plan checking fees on single family dwellings and duple~s as well as their
14 appurtenant structures.
15 SECTION IX {Transfer Fee)
16 Section 303 of said Uniform Building Code is hereby amended by adding
17 sub-section (e) as follows:
18 A building permit may be transferred from the original permittne to
19 another person due tp a change in ownership or contractor and the transfer fee
20 shall be Five Dollars 05.00),
21 SECTION X
22 Chapter 70 of the appendix of said Uniform Building Code is hereby deleted.
23 SECTION XI (Prohibition)
24 It shall be unlawful for any person, firm, or corporation to erect, con-
25 struct, alter, repair, move, remover improve, convert, or demolish, equip, use,
2$ occupy, or maintain any building or structure in the unincorporated areas of
27 the County of Butte or to cause the same to be done contrary to or in violation
28 of any of the provisions of this ordinance.
29 SECTION ~CIT (Violations)
30 Any person, firm, or corporation violating or causing or permitting the
31 violation of any of the provisions of this ordinance shall be guilty of a
32 misdemeangr and upon conviction thereof shall be punished by a fine of not more

than X500,00 or by imprisonment in the Cotuaty Jail for a term not exceeding six
(6) months or by both sue3a fine and imprisonment.
SECTION 7~II (Severability - Validity)
If arty section, subsection, sentence, clause, or phrase of this ardinance
is for any reason held by a court of competent jurisdiction to be invalid, such
decision shall not affect the validity of the remaining portions of this
ordinance. The Board of Supervisors hereby declares that it would have passed
dais ordinance and each section, sub-section, sentence, clause, and phrase
thereof irrespective of the fact that any one or more sections, sub-sections,
sentences, clauses, or phrases be declared invalid.
SECTION ~V
This nrdinarice shall take effect and be in force at the expiration of
thirty (30) days from and after its passage and before the expiration of fifteen
(15) days after its passage, sha11 be published once with the names of the
members voting for and against the same in a newspaper of general circulation
printed and published in the County of Butte.
