AN ORDINANCE OF THE COUNTY OF BUTTE ADOPTING THE 1965 EDITION OF THE UNIFORM ELECTRICAL CODE, PROVIDING FOR THE APPLICATION OF THE REGULATIONS THEREIN CONTAINED TO THE UMNCORPORATED AREAS OF THE COUNTY, PRESCRIBING PENALTIES FOR THE VIOLATION THEREOF, 1 AND REPEALING ALL ORDINANCES INCONSISTENT THEREI+ftTH. 2 The Board of Supervisors of the County of Butte do ordain as follows: 3 SECTION I 4. Ordinance No. SL. and Section 7A-1 of the County Code are hereby repealed. 5 SECTION II (Purpose) 6 In order to provide minimum standards for the proper regulation of the 7 installation of electrical systems, the Uniform Electrical Code, 1965 Edition, 8 published. by the Pacific Coast Electrical Bureau, which adopts by reference the g 1965 National Electric Code and the 196,3 Electrical Safety Orders of the State 10 of California are hereby adopted, incorporated and made a part of this ordinance 11 by reference without further publication, as though set forth at Length herein, 12 and is hereby declared to be the Electrical Code for the County of Butte and 13 shall. apply to and govern all electrical installations in the unincorporated 14 areas of said County, except as hereinafter provided. 15 SECTION III (Definition) 16 ldhenever in any of the codes adopted hereunder the following names or terms 17 are used, such name or term shall have the meaning ascribed to it by this section 1$ 83 fOllOW3, t0 W1t: 19 1. Chief Electrical Inspector shall mean the Director of Public Works of 20 the County of Butte. 21 2. Legislative Body of local agency shall mean the Board of Supervisors 22 of the County of Butte. 23 SECTION IV (Prohibition} 24 It shall be unlawful for any person, firm, or corporation either as an 2g owner, lessee, architect, contractor, artisan, or otherwise to make arty installa-• 26 tion, alteration, or repair, or to cause, permit, or suffer the same t3 be done 2'7 of any electrical wiring, devices, appliances, or equipment in the unincorporated 28 areas of said Gouaty contrary to or in violation of any of the provisions of this 29 ordinance. 30 SECTION V (Exceptions) 31 Section "2A" of the Uniform Electrical Code, 1965 Edition, is hereby 32 amended by adding thereto Paragraphs 5, 6, and 7, which as added shall read as 7 1 2 3 4I 5 6 7 8 9 10 11, 12 13 14 I 15 16 17 18 19 '' 20 32 5. No permit shall be required for arty' agricultural building or structure. Agriesultural buildings are defined as follows: ~~Agricultural building is a building located on agricultural property and used to shelter farm implements, hay, grain, poultry, livestock, or other farm produces in which there is no human habitation and which is not used by the public°. 6. No permit shall be required for small unimportant detached structures, i.e., tool sheds, ~~tood sheds, and work shops with a total area including additions of less than 200 square feet and whose occupancy is classified as Type Jas defined in the 196. Uniform Building Code as published by the International Conference of Building Officials, except that this exemption shall. not apply to laundry buildings, bath houses, carports, and garages. 7. No permit shall be required for the installation, alteration or repair of agricultural water pumps used solely far agricultural purposes. SECTION VI (Permit Expiration) Every electrical permit issued under the provisions of this ordinance shall sire by limitatian and become null and void after one (1) year from the date issuance of said permit; prrovided however, if said electrical permit is issued conjunction with a building permit, said electrical permit will remain active long as the building permit is native, SECTION VII (Transfer Fee) Section 3 of the Uniform Electrical Code, 1965 Edition, is hereby amended adding thereto the following paragraph: "An electrical permit may be transferred from the original permittae to another person due to Change in ownership or contractor and the transfer fee shall be Two Dollars (~2.00).~~ SECTION VIII (Appeals Board) The Loaal.Appeals Board of the County of Butte which was established by olution No, 6/~~-3 by the Butte County Board of Supervisors shall hear any and appeals regarding the application and enforcement of this ordinance. -2- 1 SECTION TX (Severability - Valiiity) 2 If any section, sub-section, sentence, clause, or phrase of this ordinance 3: is for any reason held by a court of competent jurisdiction to be invalid, such 4` decision shall not affect the validity of the remaining portions of this 5 ordinance. The Board of Supervisors hereby declares that it would have passed 6 this ordinance and each section, sub-section, sentence, clause, and phrase 7 thereof irrespective of the fact that any one or more sections, sub-sections, 8 sentences, clauses, or phrases be declared invalid. 9 SECTION X (Violations) 10` Any person, firm, or corporation violating or causing or permitting the 11 violation of any of the provisions of this ordinance shall be guilty of a 12 misdemeanor and upon conviction thereof shall be punished by a fine of not more 13' than $500.00 or by imprisonment in the County Jail for a term not exceeding six 14' (6) months or by both such fine and imprisonment. 15 SECTION XI 16 This ordinance shall take effect and be in force at the expiration of thin 17 (30) days from and after its passage and before the expiration of fifteen (15) 18 days after its passage shall be published once with the names of the members 19' voting for and against the same in a newspaper of general circulation printed 20 and published in the County of Butte. 21. 22 23: 24 28 26 27 28 29 30 31 32 -3- PASSED AND ADOPTED THIS 31st day of May , 1966, by the fallowing vote: AYES: Supervisors iiowsden, Maxon, McKillop and Chairman Giles NOES: idone ABSENT: Supervisor Pryde 8 9 10 11 12 13 14 15 16 17 18 19 20. 21 22 23: 24 25 26 27 28 29 30 31 32 I _ ~~~ ~~~~ Chaff of the Board of Supervisors of the County of Butte ATTEST: JESSIE ROGERS Butte County Glerk and ex-officio Clerk of the Board of Supervisors BY ~J~ Dep~y~ Clerk -4-
