AN ORDINANCE OF THE COUNTY OF BUTTE ADOPTING BY REFERENCE
THE UNIFORM PLUMBING CODE, 196. EDITION, WITH APPENDICES
THERETO, AS PREPARED AND PUBLISHED BY THE WESTERN PLUMBING
OFFICIALS ASSOCIATION: .PROVIDING FOR THE APPLICATION OF
l SAID UMFORM PLUMBING CODE IN THE COUNTY OF BUTTE AND
PROVIDING PENALTIES FOR THE VIOLATION THEREOF.

3 The Board of Supervisors of the County of Butte do ordain as follows:
4. SECTION I (4'urpose)
5 Except as hereinafter provided, that certain Plumbing Code known and
6 designated as the Uniform Plumbing Code, 19b~. Edition, together with appendices
ry thereto, as prepared and published by the Western Plumbing Officials Associatio:
8 is hereby referred to, adopted, and made a part of this ordinance with the same
9 effect as if fully set forth herein and is hereby declared to be the Plumbing
10. Code of the County of Butte, and all the provisions thereto shall apply to all
I1 of the unincorporated areas of the County of Butte.
I2' SECTION II
13 Section 1.1 of said Uniform Plumbing Code is hereby amended to read as
14 follows:
15 Section 1.1 -Whenever $he term "Administrative Authority" is used in
16 this Code, it shall mean the Director of Public Works of the County of Butte.
17 SECTION III
18 Section 1.2 of said Uniform Plumbing Code is hereby amended to read as
19 follows:
20 Section 1.2 - Whenever the term "Assistants" is used in this Code, it
2L shall mean the duly appointed assistants of the Director of Public Works.

23 Sub-section 10 of Section 1.1~ of said Uniform Plumbing Code is hereby
24 deleted.
2S SECTION V (Permit Expiration)

27 and add the following:
28 Every plumbing permit issued under this Code shall expire by limitation
29 and become null and void after one (1) year from the date of issuance of said
30 permit; provided however, if said plumbing permit is issued in conjunction
31 with a building permit, said plumbing permit will remain active as long as the
32 building permit is active.

1 SECTION VI (Exemptions)
2 Add to Section 1.9 of said Uniform Plumbing Code the following paragraphs:
3 No permit shall be required for any agricultural building or structured
4 Agricultural buildings are defined as follows: "Agricultural building is a
5 building located on agricultural property and used to shelter farm implements,
g hay, grain, poultry, livestock, and other farm produce, in which there is no
7 human habitation and which is not used by the public".
8 No permit shall be required for small unimportant detached structures, ice
g tool sheds, wood sheds, and work shops rra,th a total net area including addition
10 of less than 200 square feet and whose occupancy would be classified as Type J
11 as defined in the 196.4 Uniform Building Code as published by the International
I2 Conference of Building Officials, except that this exemption shall not apply to
13 laundry buildings, bath houses, carports, and garages.
14. SECTION VII
15 Section 1.10 of said Uniform Plumbing Code is hereby deleted.
16 SECTION VIII (Transfer ~'ee)
17 Add to Section 1.12 of said Uniform Plumbing Code the following paragraph:
18 A plumbing permit may be transferred from the original permittee to anothe
19 person due to change in ownership or Contractor and the transfer fee shall be

21 SECTION IX
22 Sections 2.1 -- 2.11 of said Uniform Plumbing Code are hereby deleted.
23 SECTION X
24 Sections llO1 - 111.8 excepting therefrom Sections 1102 and-°1108 of said
2$ Uniform Plumbing Code are hereby deleted.
28 SECTION XI (Gas Piping)
27 Add to Section 1212 of said Uniform Plumbing Code the following sub-
28 section:
29 (e) Galvanized piping shall not be used for any type of gas piping.
30 SECTION 7QI (Appeals Board)
31 The Local Appeals Board of the County of Butte which was established by
32 Resolution No. 6L~-3 by the Butte County Board of Supervisors shall hear any`~and

fall appeals regarding the application and enforcement of this ordinance.
SECTION XIII (prohibition)
It shall be unlawful for any person, firm, or corporation to install,
alter, or repair any plumbing or drainage facilities, or to perform any other
act, contrary to or in violation of any provisions of said Uniform Plumbing
Code of this ordinance.
SECTION XIV .(Violations)
Any person, firm, or corporation violating or causing or permitting the
violation of any of the provisions of this ordinance shall be guilty of a
misdemeanot and upon conviction thereof shall be punished by a fine or not more
than $500.00 or by imprisonment in the County Jail for a term not exceeding six
(6) months or by both such fine and imprisonment.
SECTION XV (Severability - Validity)
If any section, sub-section, sentence, clause, or phrase of this ordinance
is for any reason held by a court of competent jurisdiction to be invalid, such
decision shall not affect the validity of the remaining portions of this
ordinance. The Board of Supervisors hereby declares that it would have passed
this ordinance and each section, sub-section, sentence, clause, and phrase
thereof irrespective of the fact that any one or more sections, sub-sections,,
sentences, clauses, or phrases be declared invalid.
SECTION XVI
This ordinance shall take effect and be in force at the expiration of thirty
(30) days from and after its passage and before the expiration of fifteen (15)
days after its passage shall be published once with the names of the members
voting for and against the same in a newspaper of general circulation printed
and published in the County of Butte.
