RESOLUTION OF THE COUNTY OF BUTTE ANNEXING TERRITORY TO
COUNTY SERVICE AREA N0. 99 (SACRAMENTO AVENUE ESTATES)
WHEREAS, S&L Developers has petitioned the Local Agency
Formation Commission for inclusion of their parcels within County Service
Area No. 99; and
WHEREAS, the Butte County Local Agency Formation Commission
has approved this annexation and designated it: 88-37 - Annexation to
CSA I199 - Sacramento Avenue Estates, the exterior boundaries of which
are described in Exhibit "A" attached hereto and made a part hereof by
this reference; and
WHEREAS, the Butte County Local Agency Formation Commission
has duly approved and authorized the Board of Supervisors to annex such
territory without notice and hearing by the Board and without an
election; and
WHEREAS, the territory is uninhabited; and
WHEREAS, the reason for this annexation is to provide street
lighting and storm drainage maintenance .
NOW, THEREFORE, BE IT RESOLVED that said territory described
in Exhibit "A" described as 88-37 - Annexation to CSA 499 - Sacramento
Avenue Estates, is hereby annexed to and included within the boundaries
of County Service Area No. 99.
BE IT FURTHER RESOLVED that said territory shall be taxed to
pay any indebtedness or liability of County Service Area No. 99 prior to
or existing at the time of annexation.
PASSED AND ADOPTED by the Butte County Board of Supervisors
on this 24th day of January 1989, by the following vote:
AYES: Supervisors McInturf, Vercruse and Chairman Fulton
NOES: None
ABSENT: Supervisors Dolan and McLaughlin
NOT VOTING: None
