RESOLUTION OF THE BUTTE COUNTY BOARD OF SUPERVISORS APPROVING THE
ADOPTION OF THE BUTTE COUNTY HAZARDOUS WASTE MANAGEMENT PLAN 1989
WHEREAS, the Butte County Planning Department has prepared a
proposed Hazardous Waste Management Plan for Butte County pursuant to
Sections 25135 et seq. of the Health and Safety Code; and
WHEREAS, Health and Safety Code Section 25135.7(a) requires
Butte County to submit the proposed Hazardous Waste Management Plan to
each incorporated city in the County; and
WHEREAS, the Hazardous Waste Management Plan has been
approved by a majority of the cities within the County which contain a
majority of the population of the incorporated area of the County; and
WHEREAS, Butte County, through the Planning Department, has
prepared a Final Environmental Impact Report with respect to the
subject of this Resolution, consistent with State of California EIR
Guidelines and Butte County EIR Guidelines; and
-WHEREAS, the proposed Butte County Hazardous Waste Management
Plan addresses:
1. An analysis of the Butte County hazardous waste stream
through the year 1994, pursuant to Health and Safety
Code Section 25135.1(d)(1).
2. The management strategies for Butte County's small
business and household hazardous waste.
3. An analysis of the need for additional hazardous waste
facilities to be sited in Butte County.
4. The identification of existing facilities in Butte
County.
5. A description of the general areas in Butte County for
new facilities using the planned siting criteria.
6. The Goals, Objectives and Policies for management of
hazardous waste within Butte County through the year
2000.
7. A hazardous waste management and implementation program
through the year 2000 attached as Exhibit C.
8. Other local programs such as public education,
enforcement, surveillance, transportation, and
administration.
WHEREAS, the local advisory committee, pursuant to Health and
Safety Code Section 25135.2, found that the proposed plan is consistent
with the legislative content and purpose of the Health and Safety Code,
Section 25135 et seq., and compatible with all elements of Butte
County's General Plans and all elements of the various incorporated
cities' General Plans; and
WHEREAS, the local advisory committee has approved and
recommended that the Board of Supervisors approve the proposal and
implementation measures contained therein.
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors
that:
1. The facts herein recited are true, and this Board of
Supervisors has jurisdiction to consider and approve the matters
therein mentioned; and
2. This Board of Supervisors does hereby approve said Butte
County Hazardous Waste Management Plan pursuant to Section 66780 of the
Government Code; and
3. The Clerk of the Board shall cause a copy of this
resolution to be sent to the Department of Health Services with copies
of the Final Butte County Hazardous Waste Management Plan.
PASSED AND ADOPTED by the Butte County Board of Supervisors
on the 4th day of January 1989, by the following vote:

The Final Environmental Impact Report, as certified by the
Board of Supervisors on November 22, 1988, is attached to the
packet submitted to the Clerk of the Board.
EXHIBIT C
SUMMARY OF GOALS AND POLICIES
GOAL - To promote hazardous waste management practices and
technologies that will, in order of priority:
- reduce the use of hazardous waste substances and the
generation of hazardous waste at their source;
- recover and recycle the remaining waste for reuse to
the extent feasible;
- treat those wastes not amenable to source reduction or
recycling so that the environment and community health
are not harmed by their ultimate release or disposal;
- ensure the safe transportation and disposal of treated
hazardous waste residuals in repositories made secure
from liquids that might create a toxic leachate and
contaminate groundwater.
GOAL - To reduce the need for additional hazardous waste
disposal sites.
GOAL - To recognize its responsibility for permitting on-site
facilities and siting off-site facilities capable of
meeting the need of generators in the county. Butte
County should seek agreements with other counties in
the region to site regionally scaled facilities
designed to meet the needs of generators from several
counties.
GOAL - To encourage active public involvement in planning for
the management of hazardous wastes.
GOAL - To promote regional cooperation between Butte County
and its adjacent county neighbors in the siting of
hazardous waste facilities and management of hazardous
wastes.
There are numerous policies which support the Goals
identified in the Plan {Chapter 2, pages 12 thru 15). Tn order to
achieve the defined goals and policies there are several actions
which must occur. These are the implementation measures.
PUBLIC EDUCATION AND PARTICIPATION
- to review reports on implementation of the plan.
- to support efforts to obtain funds for adequate
staffing for management of Butte County's hazardous
wastes.
- to assist in implementation of the waste reduction
program.
- to consider new program directions.
- to guide the small quantity generator and household
waste education programs, particularly emphasizing
recycling of waste oil.
- to promote opportunities for development of regional
cooperation in managing hazardous wastes.
- to assist Butte County communities in establishing
local environmental assessment committees for siting of
proposed hazardous waste facilities,
- to serve as a candidate pool for an Appeals Board
should one be convened by the Governor pursuant to H&SC
Section 25199.9(c).
ONGOING DATA COLLECTION AND ANALYSIS PROGRAM
- to survey the several sources of hardcopy county and
city level information on hazardous wastes including
data files on the AB 2185/87 program, the underground
storage tank program, Proposition 65 spills reports and
other relevant local programs to identify data
management and acquisition needs and shortcomings.
- to establish liaison with other hazardous waste record-
keeping agencies. Such agencies would include the
Department of Health Services, the State Water
Resources Control Board, the Central valley Regional
Water Quality Control Board, and local sanitation
agencies administering NPDES waste discharge permits.
- to design and develop a computerized database
management system that will serve local Plan
implementation and Plan update needs and that will
interface with other agency hazardous waste data
systems, Such a system shall quantify waste reduction
capabilities for each existing and potential major
waste generator,
- to review and revise local permit application forms and
inspection forms to ensure that all necessary data will
be collected.
- to coordinate with agencies preparing engineering
reports on contaminated sites to ensure that this
category of hazardous wastes in included in the Plan
database.
WASTE REDUCTION IMPLEMENTATION PROGRAM
- There are three approaches the County can take to
implement to goals;
1) it can provide information and educational
resources to industry and the community at large
on waste reduction;
2) it can provide technical assistance, a somewhat
more expensive option; or
3) the county could adopt regulatory policies to
ensure utilization of waste reduction strategies.
EDUCATIQNAL PROGRAMS
-- the Waste Reduction Subcommittee should contact trade
associations to arrange for information dissemination
regarding innovative waste reduction technologies and
industrial successes.
- the waste Reduction Subcommittee should strive to
educate small quantity generators and work with them to
use available options and technology for recycling.
TECHNICAL ASSISTANCE
- The county should consider conducting a waste reduction
audit program in coordination with generator
inspections.
-- the county should require all businesses to submit
hazardous waste reduction plans.
- the County and each city within the county shall
develop a model conditional use permit which references
the need for additional environmental review and risk
assessment.
- Waste reduction program;
ask companies in each target group to voluntarily
participate in local waste reduction program.
provide waste reduction consultations during routine
generator inspections.
require each targeted generator to submit a written
plan to the implementing agency.
assist companies in overcoming financial/regulatory
barriers to waste reduction.
develop an awards program to recognize an industry
achieving waste reduction.
propose needed legislation and local ordinances to
promote, not impede, waste reduction efforts.
develop interagency relations that will ensure that new
companies utilize the best available technologies to
reduce the amount of hazardous wastes generated and
prevent waste media transfer.
establish information exchange programs to share
successful waste reduction technologies with other
companies and staff inspectors.
carry out field audits of a limited number of selected
generators.
prepare detailed and specific recommendations in
response to the findings of the field audits.
results of field audits and subsequent recommendations
should be published through news media, letters and
seminars.
technical assistance should be provided to waste
generators to teach them how to do self audits.
STTTNG TMPLEMENTATTON
- the County is responsible for processing all siting
requests, including use permit processing and
environmental review.
- the Board of Supervisors is responsible for appointing
a Local Assessment Committee (LAC) that is responsible
for negotiating terms for project approval.
TRANSPORTATION
Butte County should designate a system of preferred
transportation routes.
- Transportation access should be included as an
evaluation criterion for the siting of hazardous waste
treatment, storage or disposal facilities in Butte
County.
- The county should evaluate the potential for rail
transportation of hazardous wastes.
FUNDING
- Consider provisions authorizing a city or county in
which there is located an off-site multi-user hazardous
waste facility to impose a tax for general purposes, or
a user fee up to an amount equal to 10~ of the
facility's annual gross receipts for hazardous waste
treated, stored, or disposed of at that facility.
- Consider requiring proponents of hazardous waste
facility projects to pay a fee which would cover the
costs of notification requirements associated with the
issuance of a Notice of Intent to apply for a hazardous
waste facility land use permit.
- Consider requiring proponents of hazardous waste
facility projects to pay a fee far the services of an
independent consultant to assist the Local Assessment
Committee in reviewing the proposed project and in
negotiating terms and conditions with the project
applicant. This is in addition to CEQA expenses.

- Consider making available funding from county resources
to allow for an additional staff person to assist in
Plan implementation.
- Co-ordinate hazardous materials and waste management
programs between the Environmental xealth and Planning
Department.
SMALL QUANTITY GENERATORS
- Consider signing a Memorandum of Understanding with the
State Department of Health Services to conduct
generator inspections.
- Consider providing inspections and consultations by
targeting the largest SQG industrial groups in the
county as identified in the plan.

- Siting of a small-scale collection recycling and
transfer station.
- Develop and administer a public education campaign.
- Prepare notification inserts far households for
inclusion in garbage bills regarding the prohibition of
disposing of hazardous wastes in the Neal Road
landfill.
CONTAMINATED SITES
- Identify a centralized location for maintenance of
contaminated site records, including review and update.
OTHER PROGRAMS
- Develop a regulatory program to ensure the proper
management of infectious wastes.
- Bring the above-ground storage program into compliance
with the City of Chico and Oroville, utilizing
information collected from the 2185/2187 program.
- Initiate a generator inspection program.
INTER-JURISDICTIONAL AGREEMENT NEGOTIATIONS
- Enter into discussions with adjacent counties for the
purpose of negotiating inter-jurisdictional agreements.
