RESOLUTION OF THE B0/{R,D OF $UPER.~I;SQR$ QF THE GQUNTY QF BUTT(r RE,VISI;NG
RULES FOR THE ADMINISTRATION OF THE ME:RI;T AND P~RSONN~L PROGRAM
WHEREAS, most employees who #ecome disabled dDd are. unable to con,ti,nue
employment:are qualified 'for diaabili.ty retirement consi;derati;on by the Pub7i;c )=,mployees
Retirement System, and
WHEREAS, the government code prohi;bi;ts the separa.ti;on of such qudli;fi;ec~
employees until an application for diaabi'li.ty retirement has "jeen, made, and
WHEREAS, such applications for safety members of the retirement system have,
been authorized to be made by the Personnel Director, a.nd
WHEREAS, the need also exists to make such applications for miace,llaneous
members without formal Board of Supervisors approval i:n each such case..
NOW, THEREFORE, BE IT RESOLVED the the Board of Supervisors of the County
of Butte amends Section 7.12 of the Personnel Rules of the County of Butte to read
as follows:
7.12 MEDICAL DEMOTION, TRANSFER, TERMINATION OR RETT:R~ME:NT
(a) The appointing authority may require an employee to submit to a medical
examination by a physician or physicians designated by the. Personnel Director
to evaluate the capacity of the employee to perform the work. of the position,
When such a requirement is made of an employee, fees for the examination shall
be paid by the County. When the appoi'nti'ng authority, after considering the
conclusions of the medical examination provided for by thia section or medi-cal
reports from the employee's physician and other pertinent i'nformati'on, finds
medical cause that tfie employee is unable to perform the work. of the present
class of position, but is qualified and able to perform the work of another
class of position of less capaci y, the appointing authoriay may i:niai-ate a
demotion or transfer of the employee to such an available posi'ti'on in the
department for which the employee meets the minimum quali:ficati'ons as
determined by the Personnel Director. When the appoi'nti'ng authority fi.nd,s a
medical cause exists and the employee is unable to perform the work of the
present position, or any other available posi'ti'on in the department, the
employee may be terminated. All original copies of medrea7 reports, fi,ndi,ngs
and information shall be submitted by the appoi'nti'ng authority to the Personnel
Director to be placed in the employee `'s file.
(b) The Personnel Director shall make applications on behalf of Butte Cvunty_
for disability retirement for all employees regardless of c7 assilfi;ca.tion and shall
initiate requests for reinstatement of such employees who are re.ti;red, for
disability.
{c) The Personnel Director shall make determinati:gns under the applicable sections
of the Government Code on behalf of Butte County of disability anal whether such.
disability is industrial related for employees classi:fi'ed as local safety members.
The Personnel Director sha11 certify such determinations and other necessary
information to the Public Employees' Retirement System.
