'.,-~, ('QU~y'i"~+-~ Resolufion No. 89-©23 t~si~~aRN RESOLUTION APPROVING AND EXECUTING THE AGREEMENT BETWEEN THE THERMALITO IRRIGATION DISTRICT AND THE COUNTY RELATED TO THE WALNUT INVESTORS ANNEXATION WHEREAS, the provisions of the Revenue and Taxation Code require an agreement between the County of Butte and Special Districts considering annexations. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors that the Agreement attached hereto as Exhibit A is incorporated herein as set forth in full and is hereby approved and executed by Butte County. PASSED AND ADOPTED by Butte County Board of Super Supervisors on this 28th day of February 1989, by the following vote: AYES: Supervisors Bolan, McInturf, McLaughlin, Vercruse and Chairman Fulton NOES: None ABSENT: None NOT VOTING: None County Board of Supervisors ATTEST: MARTIN J. NICHOLS Chief Administrative Officer and Clerk of the Board of Supervisors by AGREEMENT x 2! 31 4! 5 6 7 8 9 1.0 Z1 12 13 14 15 16 1.7 18 ~.9 2Q 2l 22 23 24 25 26 This Agreement is made and entered into this 17th day of January , 1,9$9, by and between the County of Butte, a political subdivision of the State of California, and the Thermalito Irrigation District, an independent special. district authorized by the Water Code of the State of California. WHEREAS, Part 0.5 of Division I, Section 99, Subdivision B, paragraph 5 of the Revenue and Taxation Cade provides as fellows: - "In the event that *** a jurisdictional. change would affect the service area or service responsibility of one or more special districts, the board of supervisors of the county or counties in which * * * the districts are located shall, on behalf of the district or districts, negotiate any exchange of property tax revenues." ~, WHEREAS, said section of the Revenue and Taxation Cade 'further provides in Section 99.1., Subsection (1), paragraph 3: "Notwithstanding the provisions of paragraph (5y of subdivision (b) of Section 99, any special district affected by the jurisdictional change may negotiate an its own behalf , if it so chooses . " WHEREAS, Section 99 further provides in Subsection B, paragraph 8, subpart (d): "With respect to adjustments in the allocation of property taxes pursuant to this section, a county and any local agency or agencies within the county may 1 2 3 4' 5 6 7' 8 9 10 ll ].2 13 l4 15 16 17 18 19 20 21 22 23 24 25 26 develop. and adopt a master property tax transfer agreement. Such agreement may be revised from time to time by the parties subject to such agreement.'" NOW, THEREFORE, in consideration of the premises herein- before set Forth, the parties hereto agree that no property tax exchange will occur as a result of the Walnut Investors Annexa~tlon to the Thermalito Irrigation District.
