Resolution No. -034 A RESOLUTION REVISING GATE FEES AT THE NEAL ROAD SANITARY LANDFILL IN BUTTE COUNTY WHEREAS, new legislation including but not limited to__Assembly Bill 2G~+8 (Eastin, Chapter 1319 of the Statutes of 1987)and Assembly Bill 3071 (Eastin, Chapter 263, Statutes of 1988) requires extensive changes in operation and maintenance of landfills in the State of California; and WHEREAS, new waste discharge requirements have been received from the California Regional Water Quality Control Board which require additional modifications to the operation of the landfill which include but are not limited to placing interim cover, solid waste monitoring, leachate monitoring, groundwater monitoring, vadose zone monitoring, septage pond closure, closure and post closure plan; and WHEREAS, complying with new legislation and waste discharge requirements will significantly increase the costs of operating and maintenance of the landfill; and WHEREAS, a consultant has been retained by Butte County to evaluate such increased costs and has recommended a 50~ increase in existing gate fees to provide the necessary revenue; WHEREAS, having considered this matter at a public meeting of this Board on t~farch 21, 1989, and having considered oral and written presentations submitted at sand meeting, and the data indicating the estimated costs required to operate and maintain the landfill in accordance with state law having been made available to the public prior to said meetings as required by law, and this Board having found that the proposed gate fees do not exceed such estimated costs; NOW,THEREFORE, BE IT RESOLVED by the Butte County Board of Supervisors that the gate fees for the operation and maintenance of the Neal Road Sanitary Landfill are established as set forth in Exhibit "A" attached hereto. BE IT FURTHER RESOLVED that this resolution shall be effective on April 1, 1989.
