BOARD OF SUPERVISORS ~.. 1 ~ *' COUNTY OF F~UTTE=, STATE OF CALIFORNIA :,~~ a; ' ~ _ Resolution No. ~~-.os5 RESOLUTION ESTABLISHING TWO ENTERPRISE FUNDS FOR BUTTE COUNTY SOLID WASTE MANAGEMENT WHEREAS, the California legislature adopted the Solid Waste Disposal Site Hazardous Reduction Act of 1987 (Chapter 1319 Statutes of 1987), the purpose of which is to provide long-term protection of air, water, and land from pollution due to the solid waste disposal through the preparation of closure and post-closure maintenance of solid waste landfill facilities; and WHEREAS, said Act requires that all solid waste landfill operators prepare closure and post-closure maintenance plans for every solid waste facility, and requires that any person operating a solid waste landfill on January 1, 1988 must ensure that annual deposits in a trust fund or equivalent financial arrangement will provide for adequate resources for closure and 15 years of post-closure maintenance (Health & Safety Code Section 66796.22(b); and WHEREAS, in accordance with said Act, the Auditor-Controller of Butte County has determined that the establishment of an Enterprise Fund would meet the intent of the Act; and WHEREAS, the Auditor-Controller has determined that the establishment of a second Enterprise Fund is necessary to account for funds raised for the purpose of future landfill studies and management of current operations. NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of the County of Butte, State of California, hereby establish the following Enterprise Funds: For closure and post-closure maintenance - Neal Road Closure Enterprise Fund (Health & Safety Code Section 66796.22(b) - F 7560. For current landfill management - Neal Road Landfill Enterprise Fund - F 7570.
