RESOLUTION ABANDONING A PUBLIC UTILITY EASEMENT
This matter came on regularly for hearing before the
Board of Supervisors of the County of Butte, State of California,
on Nlay 2 , 1989, in the Board Chambers, Butte County
Administration Building, Oroville, California, and it appearing
to said Board that notice of the time and place of the hearing on
the petition far abandonment of public utility easement in
question was duly and regularly given as required by law, and
testimony and evidence, both oral and documentary, having been
produced at said hearing, from which said Board now finds that
the hereinafter described public utility easement is unnecessary
for present or prospective public use.
NOW, THEREFORE, IT IS HEREBY ORDERED as follows:
1. That the public utility easement situated in the
County of Butte, State of California, as hereinafter more
particularly described, is hereby abandoned pursuant to Chapter 3
of Part 3 of Division 9 of the California Streets and Highways
Code (commencing with Section 8320).
2. That said public utility easement so abandoned is z
that certain 6-foot public utility easement lying within a

portion of the West half of Section 7, T19N, RSE, M.D.M. as shown ~p
on the Map of Kelly Ridge Estates Unit 3 recorded in Book 43, h~
Maps of Record, at Pages 44 to 48, of the County of Butte, State rn

of California, more particularly described as follows:
Being that certain 6-foot public utility
easement lying southerly of, parallel with and
contiguous to the most northerly lot line of Lot
237 of Kelly Ridge Estates Unit 3, beginning at
the northwest corner of Lot 237, thence N 74
degrees 24 feet 00 inches E, 175.07 feet to the
northeast corner of Lot 237 and the end of the
described easement.
Excepting therefrom the most westerly 20 feet
which lies within the building setback line.
Also excepting therefrom the most easterly 10
feet which lies within a public utility easement.

Said Map showing the public utility easement so
abandoned is on file in the Office of Butte County Department of
Public Works, 7 County Center Drive, Oroville, California 95965.
3. That the Clerk of this Board shall cause a certified
copy of this Resolution, with the seal of the Board of
Supervisors of the County of Butte, State of California, to be
recorded in the office of the Recorder of the County of Butte,
State of California.
PASSED AND ADOPTED by the Butte County Board of
Supervisors this 2nd day of Ma_Y , 1989, by the
following vote:
AYES: Supervisors Dolan, McInturf, Vercruse and Vice Chairman McLaughlin
NOES : None
ABSENT: Chairman Fulton
NOT VOTING: None
