HomeMy WebLinkAbout89-081~` RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF BUTTE SETTING PARK FACILITY FEES WHEREAS, the Board of Supervisozs of the County of Butte, by Ordinance Number 2750 Adopted on MaV ~., 1989, added Article IV to Chaptez 16 of the Butte County Code authprizing the assessment and levying of Park Facility Fees on any owner of real property located in the unincozporated area of the Chico Uzban Area adding residential dwelling units to such property, in order to fund the cost of the additional park facilities which will be necessary in order to meet the reczeational needs of the new residents resulting from such developments; and WHEREAS, the Board of Supervisors, by this Resolution, desires to: establish the amount of said Park Facility Fees in the mannez provided foz in said Article IV of Chapter 16 of the Butte Code; demonstrate that such fees comply with all of the factors enumerated in Section 16-30 of said Article and Chaptez of the Butte County Code; and, by zeason thereof, confirm that such Park Facility Fees meet each of the "nexus" requirements set forth in Section 66001 of the California Government Code, all for the reasons set out in Section 16- 27 of said Article and Chapter of the Butte County Code; and, WHEREAS, the Board of Supervisors has considered this Resolution at a public hearing, notice of which was given in the manner provided for by both Sections 54992 and 54994.1 of the California Government Code; and WHEREAS, the Board of Supervisors has also considered the effect which the Park Facility Fees will have on monthly housing costs, all in the manner required by the Butte County General Plan. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of the County of Butte as follows: 1. The Board of Supervisors adopts the Park Facility Fees set forth in Exhibit "A" attached hereto and by this reference incorporated herein. 2. The Board of Supervisors finds that the Park Facility Fees adopted by this Resolution comply with the requirements of Section 16- 30 of the Butte County Code, entitled "Amount of Park Facility Fees", all for the reasons set forth in the document entitled "Basis for Park Facility Fees", a copy of which is attached hereto, marked Exhibit "B" and by this reference incorporated herein. 3. The Board of Supervisors confirms that since said Park Facility Fees adopted by this Resolution comply with the requirements of Section 16-30 of the Butte County Code, such fees also meet each of the "nexus" requirements set forth in Section 66001 of the California Government Code, all for the reasons set out in Section 16-27 of the Butte County Code, entitled "Findings". 4. In accordance with the provisions of Section 65962 of the California Government Code, this Resolution as well as the Park Facility Fees provided for herein, shall not become effective until the 61st day following its adoption; provided, however, that if for any reason Ordinance Number 2750 adopted by the Board of Supervisors on May. 23, 1989, should not become effective, then this Resolution similarly shall not become effective. APPLICABILITY The fees set forth herein shall apply as to building permit applications submitted on or after Jul 24 , 1989. II. FACTORS USED TO ESTABLISH FEES/CREDITS 1. General Factors Household size 2. Factors for Basic Park Facility Fee a. Required neighborhood and community park facilities per 1000 new population b. Average land cost - unimproved c. Average park facility and public improvement cost 2.29 persons per unit 3.5 acres $40,000 per acre $50,000 per acre III. PARK FACILITY IMPROVEMENT FEES A. Park Facility Fee $722/dwelling unit EXHIBIT A BASIS FOR PARK FACILITY FEE Assum tions (Based on the Park and Recreation Plan ("Plan") of the Chico Area Recreation and Park District): - 3.5 acres of improved park land per 1,000 people {.9 acres for neighborhood park facilities and 2.6 acres for community park facilities, including 1 acre for creekside greenways, trail systems and other lineal park facilities}. See Plan, particularly at pages IV-33, 34, 35, 4I and 42 and VI-7, 8 and 25, The Flan assumes an average width of existing lineal parks at 50 feet, states that trails should be wide enough to accommodate a maintenance truck and refers to the desirable width of multipurpose paved trails as 12 feet and unpaved nature trails as 4 feet, Based upon a goal of 0.5 miles {2,640 feet) of lineal parks per 1,000 population (Plan page IV-42) at a conservative width of 16.5 feet, it would be necessary to acquire 1 acre per 1,000 new residents for lineal park facilities ( 2,640 feet x 16.5 feet = 43,550 square feet = 1 acre.} - $90,000 is the cost to acquire and improve an acre of park land. Plan page VII-2. Census Information: ~- 2.29 people per residential unit according to the 1980 k'ederal Census. Calculation: Improved Acreage $90,000/acre times 3.5 acres/1,000 people = $315,000 1,000 people divided by 2.29 people/unit = 436.68 units $315,000 divided by 436.68 units = $722/unit EXHIBIT B
