RESOLUTION CALLING A PUBLIC HEARING TO DE1'ERI~QNE WHF.TFlRR
PUBLIC NECESSITY, HEALTH, SAFETY OR WELFARE REQUIRE THE
FORMATION OF AN UNDERGROUND UTILITY DISTRICT ON THE MIDWAY
AND DURHAM-DAYTON HIGHWAY IN THS DURHAM AREA
BE IT RESOLVED by the Board of Supervisors of the County of Butte as
follows:
WHEREAS, Ordinance No. 981 establishes a procedure for the creation of
underground utility districts and requires as the initial step in such procedure
the holding of a public hearing to ascertain whether public necessity, health,
safety or welfare require the removal of poles, overhead wires and associated
overhead structures and the underground installation of wires and facilities for
supplying electric, communication, or similar or associated service in any such
district; and
WHEREAS, it has been recommended that. such an underground utility district,
hereinafter called DISTRICT, be formed on the Midway from 400 feet north of Durham-
Dayton Highway to 500 feet south of Brown Street and on Durham-Dayton Highway from
Burdick Road to the Midway.
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1. Notice is hereby given that a public hearing will be held by the
Board of Supervisors of the County of Butte on July 11, 1989, at the hour of
10.00 a_m_ in the Board of Supervisors Room of the Administration Building,
Oroville, California, to ascertain whether the public necessity, health, safety or
welfare require the removal of poles, overhead wires and associated overhead
structures and the underground installation of wire and facilities for supplying
electric, communication, or similar or associated service in the District herin-
above described.
2. At such hearing, all persons interested shall be given an opportunity
to be heard. Said hearing may be continued from time to time as may be determined
by the Board of Supervisors.
3. The County Clerk shall notify all affected property owners as shown
on the last equalized assessment roll and utilities concerned of the time and place
of such hearing by mailing a copy of this resolution to such property owners and
utilities concerned at least ten (10) days prior to the date.
4. The area proposed to be included in the District is shown upon that
certain map entitled Durham Underground Utility District No. 1 dated June 6, 1989,
which is on file in the offices of the County Clerk and Director of Public Works
of the County of Butte.
PASSED AND ADOPTED this 6th day of June 1989, by the
following vote:
AYES: Supervisors Dolan, McInturf, A1cLaughlin, Vercruse and Chairman Fulton
