~Y` "<J ~ VO"^^'~~ BARD OF` SUPERVISORS ;~: ~~; :* . ~ 'F COUNTY OF BU-f-TE, STATE OF CALIFOl~NIA ~ f ~ ~ _ ._ ~~ ,: +;~-~Q t'~ ! ; ~esolufion No. 8g- 095 , ~t4i'rrr~ RESOLUTION ABANDONING A PUBLIC RIGHT-OF-WAY This matter came on regularly for hearing before the Board of Supervisors of the County of Butte, State of California, on June 20 ~ 19gg, in the Board Chambers, Butte County Administration Building, Oroville, California, and it appearing to said Board that notice of the time and place of the hearing on the petition for the abandonment of a portion of Railroad Avenue right-of-way in question was duly and regularly given as required by law, and testimony and evidence, both oral and documentary, having been produced at said hearing, from which said Board now finds that the hereinafter described right-of-way is unnecessary for present or prospective public use. NOW, THEREFORE, IT IS ITEREBY ORDERED as follows: 1. That the public right-of-way situated in the County of Butte, State of California, as hereinafter more particularly '' described, is hereby abandoned pursuant to Chapter 3 of Part 3 of Division 9 of the California Streets and Highways Code (commencing with Section 8320). 2. That said public right-of-way so abandoned is that /~ certain real property situated in the County of Butte, State of California, described as follows: 4D t~D "A portion of Railroad Avenue as shown on Wall ~ tV Mag No. 3 of Palermo Citrus Tract Subdividion No. 1 recorded February 28, 1888, in the Office of p~ the Recorder, County of Butte, State of ..,~ California, more particularity described as follows: Being the westerly 16 feet of the existing 101 feet of Railroad Avenue right-of-way bounded on the South by the westerly extension of the northerly right-of-way line of Alice Avenue, bounded on the north by the westerly extension of the southerly right-of-way line of Louis Avenue, bounded on the west by the easterly right-of-way line of the Southern Pacific Railroad right-of- way. Said Map showing the road rights-of-way to be abandoned is on file in the Office of Butte County Department of Public Works, 7 County Center Drive, Oroville, California 95965. 3. That the Clerk of this Board shall cause a certified copy of this Resolution, with the seal of the Board of Supervisors of the County of Butte, State of California, to be recorded in the office of the Recorder of the County of Butte, State of California.
