STATE OF CALIFORNIA, COUNTY OF BUTTE
RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF BUTTE
RECOMMENDING, APPROVING AND SUPPORTING CHANGES IN PENDING
ASSEMBLY BILL RE: CHANGES IN BUTTE COUNTY MUNICIPAL COURT
SYSTEM.
WHEREAS, certain changes have been made as to salaried
positions in the Butte County Municipal Court system affecting
the Government Code Sections listed below. It is recommended
that said sections be amended as follows:
PROPOSED LEGISLATION FOR THE BUTTE COUNTY MUNICIPAL COURTS
SECTION 74936 OF THE GOVERNMENT CODE BE AMENDED TO READ:
"There shall be one clerk/administrator and one and one-half
court reporters in each judicial district who shall be appointed
by the judges of the judicial district."
SECTION 75937 OF THE GOVERNMENT CODE BE AMENDED TO READ:
"The clerk/administrator of the North Butte County Municipal
Court may appoint the following positions:
(a) One assistant clerk/administrator or supervising court clerk.
(b) Three supervising court clerks.
(c) Nine court clerks II/III, or typist clerks III.
BEFORE THE BOARD OF SUPERVISORS
{d) Four court clerks I/II, or typist clerks I/TI.
(e) One senior account clerk or account clerk.
The clerk/administrator of the South Butte County Municipal Court
may appoint the following positions:
(a) One assistant clerk/administrator or one supervising court
clerk.
(b) Two supervising court clerks, or court clerks II/ITT, or
typist clerks IIT.
(c) Three court clerks TT/III, or typist clerks ITT.
(d} Six court clerks I/II, or typist clerks I/TT.
(e) One senior account clerk, or account clerk.
SECTION 74940 OF THE GOVERNMENT CODE BE AMENDED TO READ:
"Whenever reference is made to a range number in this section of
this article, the schedule o£ biweekly salaries shall be that as
set forth in the Butte County Salary Ordinance.
{a) Clerk/administrator - range 24.5.
(b) Assistant clerk/administrator - range 17.5.
(c) Supervising court clerk - range 15.0.
{d) Court clerk I - range 9.0.
(e) Court clerk II - range 11.0.
(f) Court clerk III - range 23.0.
(g) Typist clerk III - range 10.5.
(h) Typist clerk TI - range 8.5.
(i) Typist clerk I - range 6.5.
(j) Senior account clerk - range 11.5.
(k) Account clerk - range 9.5.
(1) Court reporter - range 25.5.
SECTION 74935.G BE ADDED TO THE GOVERNMENT CODE TO READ:
"Official reporters of the Butte County Municipal Courts shall be
appointed by the judges of each municipal court district pursuant
to the provisions of section 72194 of this code and shall serve
at the pleasure of the judges."
SECTION 74935.7 BE ADDED TO THE GOVERNMENT CODE TO READ:
"Pursuant to section 72194 of this code, the judges of the
municipal courts may appoint as many additional reporters as the
business of the courts requires, who shall be known as official
reporters pro tempore. They shall serve without salary but shall
receive the fees provided by Sections 69947 to 69953 of this code
inclusive.
Proposed amendment to Government Code Section 70045.8 as follows:
Butte County; compensation
A. Notwithstanding any other provision of law, including
but not limited to Sections 70040, 74041, 70042, and 70045, the
following provisions shall be applicable to the official court
reporters in Butte County Superior Court:
1. The regular full-time official superior court
reporters under the direction of the presiding judge of the
superior court sha11 perform the following duties:
(a) Report all criminal proceedings.
(b) Report all civil commitment proceedings and
all contempt proceedings.
(c) Report all juvenile proceedings other than
those heard by juvenile court referee or traffic hearing
officer.
(d) Report all family law proceedings.
(e) Report all civil jury trials.
(f) Report all hearings on petitions for extra-
ordinary relief, including but nat limited to proceedings
for injunctions, mandate, prohibition, certiorari, review,
habeas corpus, and coram nobis.
(g) Report all proceedings of the grand jury when
requested by the foreman, or by the district attorney or by
the county counsel.
(h) Any other court proceedings when a party
requests a court reporter in accordance with rules of court,
(i) Report coroner's inquests when requested by
the coroner.
(j) Report proceedings for the Butte County Board
of Equalization when requested by the board.
(k) When not occupied with the above duties, and
upon request of a presiding judge of the municipal court and
approval of the presiding judge of the superior court, he or
she shall report matters listed in section B. 1. below.
B. Notwithstanding any other provision of law, including
but not limited to Sections 70040, 70041, 70042, and 70045, the
following provisions shall be applicable to the official court
reporters in the Butte County Municipal Courts:
1. The regular full-time official municipal court reporters
under the direction of the presiding judges of the municipal
courts shall perform the following duties:
(a} Report the preliminary examination of those
accused of crimes before magistrates with Butte County.
(b) Report all felony pleas.
(c) Report any other court proceedings as required
by law.
(d) When not occupied with the above duties, and
upon request of the presiding judge of the superior court
and approval of a presiding judge of the municipal court, he
or she shall report matters listed in Section A. 1. above.
C. The board of supervisors shall, by ordinance, specify
the salary rates for official court reporters in Butte County.
In addition to the aforementioned compensation, each
official court reporter shall receive twenty-five dollars ($25)
per month as reimbursement for the cost of necessary supplies.
The foregoing salary established pursuant to county
ordinance is for compensation of reporting services in the
superior and municipal courts under subdivisions 1 and 2 of this
section. for all transcripts incident to reporting services,
each reporter shall receive the fees provided for in Article 9
(commencing with Section 69941) of this chapter.
The regular full-time official court reporters shall be
entitled to the same privileges with respect to retirement,
vacation, sick leave, and group insurance, which either now or
hereafter may be provided by agreement to other management,
supervisory, and confidential employees of the said county.
D. When the regular full-time official court reporters are
occupied in the performance of their duties and services pursuant
to the provisions of subdivisions 1 and 2, the judge or judges of
the superior and municipal courts may appoint as many additional
official court reporters, who shall be known as official
reporters pro tempore, as the business of the courts may require
in order that the judicial business of the courts in such county
may be carried on without delay. They shall be paid in
accordance with the per diem, transcription, and other fee
provisions of Article 9 (commencing with Section 69941) of this
chapter. Such per diem, traveling and other expenses, and the
fees chargeable to the county under the terms of these provisions
shall be a proper county charge.
NOW, THEREFORE, BE IT RESOLVED by this Baard of Supervisors
that the above-cited recommendations of amendments to the
Government Code are approved, the Board supports the amendments
as indicated, and accepts the responsibility for funding of said
changes.
PASSED AND ADOPTED by the Butte County Board of Supervisors
this ISth day of August 1989, by the following
vote:
