RESOLUTION OF INTENTION TO DISSOLVE COUNTY SERVICE AREA N0. 43 WHEREAS, on October 1, 1985, the Butte County Board of Supervisors passed and adopted Resolution 85-159 making application to the Local Agency Formation Commission for the proposed dissolution of County Service Area No. 43, and, WHEREAS, on July 6, 1989, the Local Agency Formation Commission passed and adopted Resolution No. 89-38 approving the proposed dissolution of County Service Area No. 43. NOW, THEREFORE, BE IT RESOLVED AND ORDERED by the Butte County Board of Supervisors as follows: 1. Dissolution of said service area is proposed under the County Service Area Law. The type of extended service proposed to be dissolved is the study, design, construction, maintenance and operation of a sanitary sewer service. The exterior boundaries of said County Service Area No. 43 are described in Exhibit "A" attached hereto and made a part hereof by tYiis reference. 2. Pursuant to Revenue and Taxation Code, the balance of funds generated within County Service Area No. 43 for sanitary sewer services, following payment of all fees associated with the proposed dissolution, are proposed to be transferred to the County of Butte and used to grovide fire protection services within the general geographical area formerly serviced by County Serivice Area No. 43. 3. Pursuant to Revenue and Taxation Code, the balance of funds held in trust, following payment of all fees associated with the proposed dissolution, shall be transferred to the Batallion 3 Water Tender Trust Fund for the Butte County Fire Department Palermo Station, to be used for fire protection services within said area. 4. That all obligations due and owing by County Service Area No. 43 are proposed to be assumed by the County of Butte. S. The reason for the proposed dissolution is that the need for the study, design, construction, maintenance and operation of a sanitary sewer service no longer exists. 6. On October 3 19 89 , at 11:00 a.m. , a public hearing will be held on the question of dissolution of the said service area.
