This matter came nn regularly for hearing before the Board of
Supervisors of the County of Butte, State of California, on
September 19, 1989, in the Board Chambers, Butte County
Administration Building, Ornville, California, and it appearing to
said Berard that notice of the time and place of the hearing on the
petition for abandonment of public utility easement in question was
duly and regularly given as required by law, and testimony and
evidence, both oral and documentary, having been produced at said
hearing, from which said Board now finds that the hereinafter
described gublic utility easement is unnecessary for present or
prospective gublic use. ~,r7 `~
NOW, THEREFORE, IT IS HEREBY ORDERED as follows:
1. That the public utility easement situated in the County
of Butte, State of California, as hereinafter more particularly
described, is hereby abandoned pursuant to Chapter 3 of Part 3 of
Division 9 of the California Streets and Highways Codes (commencing
with Section 8320).
2. That said public utility easement so abandoned is that
certain 3-foot Public Utility Easement lying within T22N, R2E, as
shown on the map of Parkside Estates, recorded in Book 100 Maps of
Record, at pages 77 and 78, County of Butte, State of California,
more particularly described as follows:
Being a portion of that certain 3-foot Public Utility
Easement lying within Lot 2 of said subdivision,
southerly of, parallel with and contiguous to the lot
line common to Lots 1 and 2 of said Parkside Estates.
Beginning at the most northerly corner of said Lot 2;
thence S 45 degrees 27 feet 00 inches W along said common
lot line 370.54 feet to the northeasterly right of way
line of Parkside Court and the end of the described line.
Excepting therefrom the most westerly 20-feet, that
portion lying within the building setback line.
Said Map showing the public utility easement so abandoned is
on file in the Office of Butte County Department of Public Works,
7 County Center Drive, Oroville, California 95965.
3. That the clerk of this Board shall cause a certified copy
of this Resolution, with the seal of the Board of Supervisors of
the County of Butte, State of California, to be recorded in the
office of the Recorder of the County of Butte, State of California.
