Resolution No. 89-142 RESOLUTION OF INTENTION TO ESTABLISH COUNTY SERVICE AREA NO. 123 - McINTOSH AVENUE WHEREAS, pursuant to Title III, Division II, Part 2, Chapter 3 of the Government Code of the State of California, the County of Butte has petitioned the Local Agency Formation Commission for formation of County Service Area No. 123; and WHEREAS, the Local Agency Formation Commission of the County of Butte has approved the formation of County Service Area No. 123. NOW, THEREFORE, IT IS HEREBY RESOLVED that County Service Area No. 123 is proposed to be established under the terms of the aforesaid chapter in the unincorporated area of Butte County. 1. The boundary lines of the territories proposed for inclusion in the county service area are described in Exhibit "A" attached hereto and made a part hereof by this reference. 2. The county service area shall be called County Service Area 123 - McIntosh Avenue. The type of extended county services to be provided within said area are the maintenance and operation of the street lighting and storm drainage facilities. 3. The Board intends to levy a service charge to pay for the abovementioned services in County Service Area No. 123. The service charge will be assessed in accordance with Government Code No. 25210.77(1) and the Butte County Code, Section 21-85 through 21-90. Said service charge will not be assessed until review and adoption ofi a report to be considered as a public hearing scheduled for the 89/90 fiscal year. 4. On Tuesday, November 7, 1989, at 7:00 p.m. in Durham High School, Multi Use room, Putney Drive, Durham, California, a public hearing will be held on the establishment of said area. Randolph, Chief Administrative Officer nd C1erk f the Board of Supervisors By: ~nx ~ Caz.'~ Deputy i ~ - <~ . .~ ry ~~, #V'" COUNTY SERVICE AREA NO. ~~ All that certain real property situate in the County of Butte, State of California described as follows: A portion of the Pomona Addition to the City of Chico as shown on the map thereof filed May 12, 1904 in Book 4 of Maps at page 40, records of Butte County, California and being more particularly described as follows: Beginning at the intersection of the centerline of Dayton Road and the southerly line of McIntosh Avenue {formerly Linden Avenue) as said roads are shown on said map of the Pomona Addition; Thence North 72°30'00" "+~est along said southerly line of McIntosh Avenue a distance of 672.00 feet to the southwest corner of said Pomona Addition; Thence North 17°30'00" East along the westerly line of said Pomona Addition a distance of 172.00 feet to the northwest corner of Lot 13 of said Pomona Addition; Thence South 72°30'00" East along the northerly line of Lots 13, 14 and a portion of Lot 15 a distance of 134.00 to the westerly line of that certain 18 foot wise alley as shown on said map; Thence North 17°30'00" East along said line a distance of 14.00 feet to the westerly projection of the northerly line of that certain 14 foot wide alley as shown on said map; Thence South 72°30'00" East along said northerly line and Sts easterly projection across Lot 3 of said Pomona Addition a distance of 538.00 feet to the centerline of Dayton Road as shown on said map; Thence South 17°30'00" West along said centerline a distance of 186.00 feet to the point of beginning and containing 2.826 acres, snore or less. ~140-
