ESTABLISHING COUNTY SERVICE AREA N0. 122_,
COUNTY OF BUTTE, SUBJECT TO
CONFIRMATION BY THE VOTERS
WHEREAS, heretofore nn the 27th day of June, 1989, the
Board of Supervisors of the County of Butte, State of California,
adopted and passed a resolution of intention to establish a county
service area to be entitled County Service Area No. 122 (County of
Butte); and
WHEREAS, said resolution fixed the 1st day of August,
1989, at-10:00 a.m. of said day in the Board of Supervisors' room
of the County Administration building in the City of Oroville,
State of California, as the time and place for the public hearing
on the establishment of said area; and
WHEREAS, said Board at said time and place proceeded to
hold said hearing and to hear arguments both for and against the
establishment of said area; and
WHEREAS, written protests of fifty percent or more of the
registered eaters residing within the territory proposed to be
included in the area, or the owners of one-half or more of the
value of the land and improvements in the territory proposed to be
included in the area, were not received against the establishment
of said area in accordance with Section 25210.17a of the Government
Code; and
WHEREAS, on August i, 1989, said Board adopted resolution
89-116 establishing County Service Area No. 122 without an election
but, having reconsidered the matter. now wishes to establish said
service area subject to confirmation by the voters.
NOW, THEREFORE, BE IT RESOLVED by the Hoard of
Supervisors of the County of Butte, State of California, as
follaws:
1.. Resolution No. 89-115 adopted by said Board nn
August 1, 1989, is hereby rescinded.
2. Said Board hereby finds and determines that the
proceedings herein were conducted purauant to Sectinn 25210.1 et
seq. of the Government Code and that publication and notices were
given pursuant thereto; said Board finds and determines that the
fallowing services described in the resolution of intention are
extended county services: replacement of fire apgaratus, the
maintenance of volunteer fire equipment, a Life Safety-Fire
Prevention Bureau, and other structural fire protection services
nat provided to the same extent on a countywide basis both within
and without cities.
3. The Berard hereby determines to establish said county
service area, subject to confirmation by the voters of the proposed
area on the question of establishment of the area, and adopts this
resolution pursuant to Government Code Section 25210.18a.
Accordingly, a special election is hereby called to be held in
proposed County Service Area No. 122 on June 5, 1990. The question
to be submitted to the voters at said election shall be:
"should County Service Area No. 122 be established to
provide structural fire protection services?"
Said election shall be held and conducted by the County and the
ballots canvassed in accordance with the provisions of Article 1
(commencing with Section 3700) of Chapter 2, Division 4 of the
Elections Code. The County Clerk shall publish a notice of the
election pursuant to Elections Code Sections 2544 and 2653. Said
election shall be consolidated with the Primary Election to be held
in the same area on the same date. The hours of the election, the
precincts, polling places, and voting booths shall be the same, and
there shall be only one set of election officers in each of the
precincts.
4. The boundaries of said county service area are
hereby finally determined and established to be the same as are
shown on Exhibit "A" attached hereto and incorporated herein and
made a part hereof by this reference.
5. The name of said county service area is County
Service Area No. 122 (County of Butte).
6. The type of extended county services to be provided
within said area is the replacement of fire apparatus, the
maintenance of volunteer fire equipment, a Life Safety/Fire
Prevention Bureau, and other structural fire services not provided
to the same extent on a countywide basis both within and without
cities.
PASSED AND ADOPTED by the Board of Supervisors of the
County of Butte, State of California on the 26th day of September,
1989. by the following vote:
AYES: Supervisors McInturf, Dolan, Vercruse, McLaughlin and Chairman Fulton
