RESOLUTION DETERMTNTNG SUFFICIENCY OF PROTEST AND
SUBMITTING PROPOSED FIRE SUPPRESSION ASSESSMENT
TO APPROVAL BX THE VOTERS OF CSA 122

WHEREAS, heretofore on August 29, 1989, the Board of
Supervisors of the County of Butte, State of California, adopted
a Fire Suppression Assessment Report and caused it to be filed with
the Clerk of the Board; and
WHEREAS, on August 29, 1989, said Board fixed the 12th
day of Segtember at 10:00 a.m. of said day in the Board of
Supervisors' room of the County Administration building in the City
of Oroville, State of California, as the time and place for the
public hearing on said Fire Suppression Assessment Report; and
WHEREAS, said Board at said time and place proceeded to
hold said hearing; and
WHEREAS, said report proposed that an assessment be
levied pursuant to Article 3.6 (commencing with Section 50078) of
Chapter 1 of part 1 of Division 1 of Title 5 of the Government
Code; and
WHEREAS, written protests representing more than 5:K but
less than 50:K of the total amount of exgected revenue from the
assessment were filed prior to the opening of said hearing and not
withdrawn prior to conclusion of the hearing.
NOW, THEREFORE, BE IT RESOLVED by the Board of
Supervisors of the County of Butte, State of California, as
follows:
1. Said Board hereby finds and determines that the
proceedings herein were conducted pursuant to Section 50078, et
seq., of the Government Code and that publication and notices were
given pursuant thereto.
2. The Board hereby determines that protests by holders
of property interests proposed to be assessed were duly
filed and not withdrawn prior to the conclusion of the hearing and
that said protests represented more than 5~ but less than 50~ of
the total amount of expected revenue from the proposed assessment.
Accordingly, a special election is hereby called pursuant to
Government Code Section 50078.12 to be held in proposed County
Service Area 122 on June 5, 1990. The question to be submitted to
the voters at said election shall be:
"Should the Board of Supervisors of the County of Butte
be authorized to levy an assessment for fire suppression
services within County Service Area No. 122, effective
commencing with the 1990-91 fiscal year7"
3. Said election shall be sub3ect to all provisions of
the Elections Code applicable to elections called by the Board of
Supervisors of the County of Butte. Said election shall be
consolidated with the Primary Election to be held in the same area
on the same date. The hours of the election, the precincts,
polling places, and voting booths shall be the same, and there
shall be only one set of election officers in each of the
precincts.
4. The Board further determines that if said measure
and the establishment of County Service Area 122 are both approved
by a majority of the voters voting on said propositions, then the
Board may adapt an ordinance levying afire suppression assessment
in accordance herewith and with the Fire Suppression Assessment
Report adapted on August 29, 1989. Such assessment shall commence
with the 1990-91 fiscal year and be in accordance with the
following assessment rate schedule:

County of Butte, State of California on the 26th day of Segtember,
1989, by the following vote:
