HomeMy WebLinkAbout89-154~rr~'yi~ ~~pFSUPE • Q•, O. .~: i, ^-* ~ r,~; ~~ .~ `••: cove' BOARD QF SUPERV~SQRS ` COUNTY OF BUTTE, STATE OF CAL]FORNIA Resolution No. 89-15~ RESOLUTION DISSOLVING COUNTY SERVICE ARLA N0. 43 WHEREAS, on October 1, 1985, the Butte County Board of Supervisors passed and adopted Resolution No. 85-159 making application to the Local Agency Formation Commission for the proposed dissolution of County Service Area No. 43; and, WHEREAS, on July 6, 1989, the Local Agency Formation Commission passed and adopted Resolution No. 89-38 approving the proposed dissolution of County Service Area No. 43; and, WHEREAS, the reason for the proposed dissolution of County Service Area No. 43 is that the need for the study, design, construction, maintenance and operation of a sanitary sewer service no longer exists; and, WHEREAS, The Butte County Board of Supervisors held a public hearing on said proposed dissolution. NOW, THEREFORE, BE IT RESOLVED by the Butte County Board of Supervisors as follows: 1. That County Service Area No. 43 is hereby dissolved. The boundaries of said County Service Area No. 43 are described in Exhibit "A" attached hereto and made a part hereof by this reference. 2. Pursuant to Revenue and Taxation Code, the balance of funds generated within County Service Area No. 43 for sanitary sewer services, following payment of all fees associated with the dissolution, shall be transferred to the County of Butte and used to provide fire protection services within the general geographical area formerly serviced by County Service Area No. 43. 3. Pursuant to Revenue and Taxation Code, the balance of funds held in trust, following payment of all fees associated with the dissolution, shall be transferred to the $atallion 3 Water Tender Trust Fund for the Butte County Fire Department Palermo Station, to be used for fire protection services within said area. 4. That all obligations due and owing by County Service Area No. 43 shall be assumed by the County of Butte.
