RESOLUTION ESTABLISHING COUNTY SERVICE AREA NO. 121
COUNTY OF BUTTE. SUBJECT TO
CONFIRMATION BY THE VOTERS
WHEREAS, heretofore on the 27th day of June, 1989, the
Board of Supervisors of the County of Butte, State of California,
adopted and passed a resolution of intention to establish a county
service area to be entitled County Service Area No. 121 (County of
Butte); and
WHEREAS, said resolution fixed the 1st day of August,
1989, at 10:00 a.m. of said day in the Board of Supervisors' room
of the County Administration building in the City of Oroville,
State of California, as the time and place for the public hearing
on the establishment of said area; and
WHEREAS, said Board at said time and place proceeded to
hold said hearing and to hear arguments both for and against the
establishment of said area; and
WHEREAS, written protests of fifty pezcent or more of the
registered voters residing within the territory proposed to be
included in the area, or the owners of one-half or more of the
value of the land and improvements in the territory proposed to be
included in the area, were not received against the establishment
of said area in accordance with Section 25210.17a of the Government
Code.
NOW, THEREFORE, BE IT RESOLVED by the Board of
Supervisors of the County of Butte, State of California, as
follows:
1. Said Board hereby finds and determines that the
proceedings herein were conducted pursuant to Section 25210.1 et
seq. of the Government Code and that publication and notices were
given pursuant thereto; said Board finds and determines that the
following services described in the resolution on intention are
extended county services: animal control services not provided to
the same extent on a countywide basis both within and without
cities.
2. The Board hereby determines to establish said county
service area, subject to confirmation by the voters of the proposed
area on the question of establishment of the area, and adopts this
resolution pursuant to Government Code Section 25210.18a.
Accordingly, a special election is hereby called to be held in
proposed County Service Area No. 121 on June 5, 1990. The question
to be submitted to the voters at said election shall be:
"Should County Service Area No. 121 be established and
an annual service charge levied therein to provide animal
control services, said service charge not to initially
exceed $4.95 per parcel of real property and not to be
increased annually thereafter by more than 100?
Said election shall be held and conducted by the County and the
ballots canvassed in accordance with the provisions of Article 1
(commencing with Section 3700} of Chapter 2, Division 4 of the
Elections Code, The County Clerk shall publish a notice of the
election pursuant to Elections Code Sections 2544 and 2653. Said
election shall be consolidated with the Primary Election to be held
in the same area on the same date. The hours of the election, the
precincts, polling places, and voting booths shall be the same, and
there shall be only one set of election officers in each of the
precincts.
If a majority of the votes cast upon the above ballot question
are in favor of establishment of said service area, then the Board
intends to levy a service charge to pay for the above-mentioned
services, effective commencing with the 1990-91 fiscal year. The
service charge will not be assessed for any fiscal year until the
report required by Government Code Section 25210.77a and Butte
County Code Section 21-87 has been filed and adopted following a
public hearing held thereon pursuant to Government Code Section
25210.77a and Butte County Code Sections 21-88 and 21-89. Said
service charge for fiscal year 1990--91 shall not exceed $4.95 per
parcel of real property and shall not be increased annually
thereafter by more than a percentage equal to the percentage
increase in Butte County's spending limit pursuant to Article 13B
of the California Constitution as calculated by the County Auditor.
3. The boundaries of said county service area are
hereby finally determined and established to be the same as are
shown on Exhibit "A" attached hereto and incorporated herein and
made a part hereof by this reference.
4. The name of said county service area is County
Service Area No. 121 (County of Butte).
5. The type of extended county services to be provided
within said area is animal control services not provided to the
same extent on a countywide basis both within and without cities.
PASSED AND ADOPTED by the Board of Supervisors of the
County of Butte, State of California on the ~rd_ day of October,
1989, by the following vote:
AYES: Supervisors Dolan, Vercruse, McLaughlin and Chairman Fulton
