RESOLUTION OF THE COUNTY OF BUTTE ANNEXING TERRITORX TO
COUNTY SERVICE AREA N0. 24 - DRAKE HOMES .
WHEREAS, Drake Homes has petitioned the Local Agency Formation
Commission for inclusion of 70.66 acres within County Service Area No.
24; and
WHEREAS, the Butte County Local Agency Formation Commission
has approved this annexation and designated it 89-39 - Annexation to
County Service Area No. 24 - Drake Homes, the exterior boundaries of
which are described in Exhibit "A" attached hereto and made a part
hereof by this reference; and
WHEREAS, the Butte County Local Agency Formation Commission
has duly approved and authorized the Board of Supervisors to annex
such territory without notice and hearing by the Board and without an
election; and
WHEREAS, the territory is uninhabited; and
WHEREAS, the reason for this annexation is to provide storm
drainage and flood protection .
NOW, THEREFORE, BE IT RESOLVED, that said territory described
in Exhibit "A" described as 89-39 - Annexation to County Service Area
No. 24 - Drake Homes, is hereby annexed to and included within the
boundaries of County Service Area No. 24.
BE IT FURTHER RESOLVED that said territory shall be taxed to
pay any indebtedness or liability of County Service Area No. 24 prior to
or existing at the time of annexation.
PASSED AND ADOPTED, by the Butte County Board of Supervisors on
this 31St day of October , 1989, by the following vote:
AYES: Supervisors Vercruse, Pic Laughlin and Chairman Fulton
NOES: None
ABSENT: Supervisors McInturf and Dolan
