~~~~ .. ~.~ }OQ~ ~ ~-~ ''~~ BOARD OF~ SUP'~ERV~SORS y ~ ~ F '~ ^~~ ,. ;~~ C©UNTY OF BUTTE, STATE {~F Cr-lLIFORNIA ' i'~' 'y'i ~~; ~'°~ ` ~~ Resojufion No. 89-198 RESOLUTION ABANDONING A PUBLIC RIGHT-OF-WAY WHEREAS, this matter came on regularly for hearing before the Board of Supervisors of the County of Butte, State of California, on November 21, 1989, in the Board Chambers, Butte County Administration Building, Oroville, California; and, WHEREAS, it appearing to said Board that notice of the time and place of the hearing on the petition for the abandonment of the right-of-way in question was duly and regularly given as required by law; and, WHEREAS, testimony and evidence, both oral and documentary, having been produced at said hearing, from which said Board now finds that the hereinafter described right-of-way is unnecessary for present or prospective public use. NOW, THEREFORE, IT IS HEREBY ORDERED as follows: 1. That the public right-of-way situated in the County of Butte, State of California, as hereinafter more particularly described, is hereby abandoned pursuant to Chapter 3 of Part 3 of Division 9 of the California Streets and Highways Code (commencing with Section 8320). 2. That said public right-of-way so abandoned is located in the unincorporated area of the County of Butte, State of California, east of Biggs, east of Dos Rios Road, north and west of Lattin Road and more particularly described as follows: "Being a portion of that certain 50-foot right- of-way lying within Section 17, T18N, R3E, S9-~T~13~ M.D.M., also lying within the Hatch-And-Rock Orchard Tract Subdivision No. 4, as shown on the Map of said subdivision recorded in Book 6, Maps of Record, at Page 77, County of Butte, State of California, more particularly described as follows: Being that portion of Lot A bounded on the North by the southerly lot lines of Lots 24 through 27 of said subdivision; bounded on the South by the northerly lot lines of Lots 28 through 31 of said subdivision; bounded on the West by the easterly 1 ~~-~~~~ ~ right of way line of Dos Rios Road, and extending easterly 1391.2 feet more or less to a point 5 feet westerly of the westerly right of way line of that certain 50 foot road known as Lattin Road. Containing 1.60 acres more or less." Said Map showing the right of way to be abandoned is on file in the Office of Butte County Department of Public Works, 7 County Drive, Oroville, CA. 3. That the Clerk of this Board shall cause a certified copy of this Resolution, with the seal of the Board of Supervisors of the County of Butte, State of California, to be recorded in the office of the Recorder of the County of Butte, State of California.
