HomeMy WebLinkAbout89-207'ems: ,,A~. ~, QUA°F~U OF SUPERVfSORS ;~. ~ '.~~~ COUNTY OF BUTTE, -STATE OF CALIFORNIA ~''O.U?$ , Resolufion' No. sg_207 4~+sa~i~+~ RESOLUTION ABANDONING A PUBLTC RIGHT-OF-WAY (PORTION OF FLETCHER ROAD) WHEREAS, this matter name on regularly for hearing before the Board of Supervisors of the County of Butte, State of California, on Oecembee 5 1988, in the Board Chambers, Butte County Administration Building, Oroville, California; and, WHEREAS, it appearing to said Board that notice of the time and place of the hearing on the petition for the abandonment of the right-of-way in question was duly and regularly given as required by law; and, WHEREAS, testimony and evidence, both oral and documentary, having been produced at said hearing, from which said Board now finds that the hereinafter described public service easement is unnecessary for present or prospective public use. NOW, THEREFORE, IT IS HEREBY ORDERED as follows: 1. That the public right-of-way situated in the County of Butte, State of California, as hereinafter more particularly described, is hereby abandoned pursuant to Chapter 3 of Part 3 of Division 9 of the California Streets and Highways Code (commencing with Section 8320). 2. That said public right-of-way so abandoned is located in the unincorporated area of the County of Butte, State of California, is identified as the westerly 1200 feet of Fletcher Road, approx. one mile west of its intersection with District Center Drive, Oroville area and is more particularly described as follows: B9-#931f Being a portion of that certain 60-foot right-of- way known as Fletcher Road lying within Section 2, T 18 N, R4E, M.D.B. & M. as shown on the map of Fortune Acres Unit No. 1, recorded in Book A maps of record at pages 23, 23A and 24, County of Butte, State of California. more particularly described as follows: Being that certain portion lying between Lots 9 and 10 of said Fortune Acres Subdivision and lying 30 feet of each side of the following 1 89-493 described centerline. Beginning at ,he most westerly point of said Lots 9 and l0 of said subdivision lying on said centerline of Fletcher Road; thence along said centerline the following three barings and distances, N 88 degrees 27' E, 421.00 ft; thence N 64 degrees 15' E, 932.70 ft.; thence S 78 degrees 55.00 ft, to the end of the described centerline and the southeasterly corner of said Lot 9. 3. That a map showing the right-of-way hereby abandoned is on file in the Office of Butte County Department of Public Works, 7 County Center Drive, Oroville, California 95965. 4. That the Clerk of this Board shall cause a certified copy of this Resolution, with the seal of the Board of Supervisors of the County of Butte, State of California, to be recorded in the office of the Recorder of the County of Butte, State of California.
