PROCESSING DEBTOR PAYMENTS IN SMALL CLAIMS JUDGMENTS
WHEREAS, AB 2164 was signed into law on September 29,
1989 amending Section 117.9 of the Code of Civil Procedure; and
WHEREAS, Section 117.9 (b) of said code now provides that
judgment debtors at their option may make payment of small claim
judgments directly to the court in which the judgment was entered;
and
WHEREAS, the courts shall establish procedures for
processing said payment to the creditor of the small claim
judgments; and
WHEREAS, Section 117.9 (c) (2) provides that the Board
of Supervisors may set a fee, not to exceed the actual cost of
administering this subdivision, up to a maximum of $25, which shall
be paid by the judgment debtor;
WHEREAS, this Board finds that the estimated average
costs of administration will be not less than $25 for each case.
THEREFORE, BE IT RESOLVED that the Butte County Board of
Supervisors hereby establishes the fee of $25 for implementation
of this procedure, said fee to be payable in advance by the debtor.
PASSED AND ADOPTED, this 19th day of December, 1989 by
the following vote:
AYES: Supervisors Dolan, McInturf, McLaughlin and Chairman Fulton
NOES: None
ABSENT: Supervisor Vercruse
NOT VOTING: None
