OF BUTTE, .STATE OF CALIFORNIA: Resolufiott No.90-05 RESOLUTION RESCTNDING RESOLUTION 84-09 AND RE--AUTHORIZING THE COUNTY CLERK TO LEVY A CHARGE FOR CANDIDATE STATEMENTS WHEREAS, §10012 of the Elections Code of the State of California permits candidates for elective office in any local agency, city, county, city and county, or district to prepare a candidate's statement, nn a form provided by the County Clerk, to be sent to each voter together with the sample ballot; and WHEREAS, said §10012 further permits a local agency so choosing to require each candidate availing himself/herself of said service to pay in advance his or her pro rata share of the estimated costs of printing, handling, translating, and mailing incurred by the local agency as a result of providing said service; and WHEREAS, Board of Supervisors Resolution 84-09 previously authorized the County Clerk to charge in advance for costs associated with candidate statements; and WTiEREAS, the Exhibits attached as part of Resolution 84-09 are no longer pertinent. NOW, THEREFORE, BE IT RESOLVED that the Butte County Board of Supervisors hereby rescinds Resolution 84-09. BE IT FURTHER RESOLVED that the Butte County Board of Supervisors hereby authorizes the County Clerk to require a candidate availing himself/herself of the service provided for by §10012 of the Elections Code of the State of California to pay in advance his or her pro rata share of the estimated costs of printing, handling, tran- slating, and mailing the candidate's statement as shown in Exhibit A attached. Im the event of underpayment, the County Clerk shall require the candidate to pay the balance of the cost incurred. In the event of overpayment, the County Clerk shall pro rate the excess share among the candidates paying estimated costs and refund the excess amount paid within 30 days of the election. -2- BE IT FURTHER RESOLVED that the County Clerk, shall make available the opportunity for a candidate to file an application, in the form attached hereto as Exhibit B, in lieu of pre-payment of his or her pro rata share of the estimated costs. However, this does not relieve the candidate of the obligation to pay the candidate statement costs in the manner established by the Elections Department. When there are mare than three. candidates filing- statements, the deposit will be half that shown above. EXHIBIT "B" AFFIDAVIT OF FINANCIAL WORTH IN SUPPORT OF APPLICATION TO FILE CANDIDATE'S STATEMENT WITHOUT ADVANCE PAYMENT OF ESTIMATED COST NOTICE TO CANDIDATE: Butte County Voter Registration and Elections Department will review and make a final determination of your eligibility as an indigent as soon as possible after submittal of this form. Tf it is determined that you are not indigent, you will be notified of this finding. Within three days of notification, excluding Saturdays, Sundays, and state holidays, you must either withdraw your statement or pay the requisite estimated cost. If you fail to respond within the time prescribed, this office will not print and mail the statement. Tf~it is determined that you are indigent, this office shall print and mail the statement without requesting pre-payment of the estimated cost. This, however, does not relieve you of your obligation to pay the candidate statement cost in the manner established by this department.
