HomeMy WebLinkAbout90-036r y„ r.~~r % `~ = ~:- Cc7UNTY OE BUTTE, STATE OF CALIFORNIA ?,~; , .... ~ Resolution No. 90-36 RESOLUTION ABANDONING A PUBLICADJACIENT TOSS (PUBLIC UTILITY EASEMENT LOT 124, PARADISE PINES IINIT #2) WHEREAS, this matter came on regularly for hearing before the Board of Supervisors of the County of Butte, State of on otir~~ar„ ~~ , 1990, in the Board Chambers, Butte California, F- County Administration Building, Oroville, California; and, WHEREAS, it appearing to said Board that notice of the time and place of the hearing on the petition for the abandonment of public service easement in question was duly and regularly given as required by law; and, WHEREAS, testimony and evidence, both oral and documentary, having been produced at said hearing, from which said Board now finds that the hereinafter described public service easement is unnecessary for present or prospective public use. NOW, THEREFORE, TT IS HEREBY ORDERED as follows: ~ ~ .. n d ~ n 1, That the public service easement situated in the t3 7 7 Count of Butte, State of California, as hereinafter more y particularly described, is hereby abandoned pursuant to Chapter 3 of Part 3 of Division 9 of the California Streets and Highways Code (commencing with Section 8320). 2, That said public service easement so abandoned is located in the unincorporated area of the County of Butte, State of California, is identified as a 20 ft. wide Public Utility Easement located northerly of and adjacent to the southerly line of Lot 124 of Paradies Pines Unit #2, AP 64-70-17, and is more particularly described as follows: Being that certain 20-foot Public Utility Easement lying within a portion of the S.E. quarter of Section 14, T23N. R3E, M.A.M. as shown on the map of Paradise Pines Unit No. 2 recorded in Boole 35 Maps ofStaterofa Caligfornia ~omore County of Butte, particularly described as follows: That certain 20-foot Public Utility Easement lying within, parallel with and northerly of the south lot line of Lot 124 of said Paradise Pines 2 Unit No. 2. Beginning at the southeast corner of said Lot 124; thence N 89 degrees 37' 23" W along the said south lot line of Lot 124, 183.83 feet to the southwest corner of said lot 124. Excepting therefrom the portion of the 20-foot Public Utility Easement lying within the 20 foot building setback line. 3. That a map showing the public service easement hereby abandoned is on file in the Office of Butte County Department of Public Works, 7 County Center Drive, Oroville, California 95965. 4. That the Clerk of this Board shall cause a certified copy of this Resolution, with the seal of the Board of Supervisors of the County of Butte, State of California, to be recorded in the office of the Recorder of the County of Butte, State of California.
