A RESOLUTION AMENDING RESOLUTION N0. 90-35,
A RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF BUTTE
ADOPTING AN ORDER FOR A BOND ELECTION OF THE PROPOSITION OF
FINANCING COUNTY JAIL FACILITIES
WHEREAS on February 27, 1990, by its adoption of Resolution
No. 90-35, this Board of Supervisors (the "Board") adopted an
order calling and providing for a bond election of the
proposition of financing certain County of Butte {the "County")
fail facilities by the issuance of general obligation bonds
pursuant to the provisions of Article 1, commencing with Section
29900, of Chapter 6 of Division 3 of Title 3 of the Government
Code of the State of California (the "Act"};
WHEREAS, the Act requires that such order shall state, among
other things, the maximum rate of interest on the proposed bonds;
WHEREAS, the maximum rate of interest on the proposed bonds
shall be the rate of not to exceed twelve percent {32~) per
annum, or such higher rate as may be authorized by law at the
time of the sale of the bonds.
NOW, THEREFORE, BE IT RESOLVED, that Resolution No. 90-35 is
amended, nunc pro tune, by adding the following at the end of the
second full paragraph on page 2 of Resolution No. 90-35 after the
words "by the taxing power of the County.°: "The maximum rate of
interest on said bonds is to be not more than the rate of twelve
per cent (l2~) per annum, or such higher rate as may be
authorized by law at the time of the sale of the bonds."
BE IT FURTHER RESOLVED that the form of resolution. to be
published by the Clerk of the Board, as authorized and directed
by Resolution No. 90-35, shall be said Resolution No. 90-35 as
amended by this Resolution.
