HomeMy WebLinkAbout90-081S~~r^ ~'~ Y~ ' :j - ~ '~ '' BOARD OF SUPERVISORS ~. , aF ~ ~~~' C4UNTY 4F E3UTTE, STATE QF C,4LIF~RNIA * , + • ~ 'Y ?tiy r' ~ ~~ , •~ Resolution No.90~s1 COUNTY OF BUTTE RESOLUTION REQUESTING WAIVER OF COUNTY MATCHING FUND REQUIREMENT FOR THE HOMICIDE TRIAL REIMBURSEMENT PROGRAM PURSUANT TO GOVERNMENT CODE SECTION 15202 AND 11019.6 WHEREAS, Butte County is in such serious financial difficulties that it is comtemplating bankruptcy unless sufficient financial relief is received; and WHEREAS, it is projected that Butte County will not be able to balance its 1990-91 budget with revenues currently anticipated; and WHEREAS, due to such financial difficulties, reductions in county services and other drastic actions have occurred including but not limited to the following: A) The number of Sheriff's Deputies has been reduced to less than 50% of the 1980-81 per capita level and is the lowest per capita of any other county; B) The Libraries were closed in 1989-90 and would still be closed except for city and private party contributions; C) Reserves are less than 1/2 of 1% of the final budget appropriation; D) Employee compensation lags so far behind comparable counties and other local agencies that the turnover rate of employees is approximately 20% per year, and the County is experiencing extreme difficulty attracting and retaining personnel; E} In order to balance the 1989-90 budget without closing fire protection stations, it was necessary to obtain deferral of $2.8 million contractural obligation to the State of California for fire protection services; and WHEREAS, tremendous growth in required costs for programs such as jail operations, Public Defender and General Assistance among others are consuming limited revenues previously used for such local programs as described above; and WHEREAS, such financial hardship has been documented by a report commissioned by the State of California Department of Finance issued in December 1989 by Richard L. Cutting and further supported by the Legislative Analyst in its policy brief of December 1989 entitled "County Fiscal Distress - A Look at Butte County;" and WHEREAS, Government Code Section 11019.6 authorizes the California Depart- meat of Finance to waive the County's obligation to share in the cost of the homicide reimbursement program following a request by the Board of Supervisors adopted after a public hearing. NOW, THEREFORE, BE IT RESOLVED that in accordance with Government Code Section 11019.6 the California Department of Finance is requested to waive Butte County's legal obligation to meet a matching fund requirement or other- wise to provide a share of the cost of the program for reimbursement of homicide trial costs pursuant to Government Code Section 15202 in accordance with the attached schedule.
