HomeMy WebLinkAbout90-083o ':~ q '~; .~~ ' BOARD OF SUPERVISO'RS' '!'~` ' S ~'~~ COUNTY- OF BUTTE, STATE OF CALIFORNIA Resolution No. 90-83 RESOLUTION ABANDONING A PUBLIC RIGHT-OF-WAY (PORTION OF YOLO AVENUE & 6TH STREET, THERMALTTO AREA) WHEREAS, this matter came on regularly for hearing before the Board of Supervisors of the County of Butte, State of California, an May 22 1990, in the Board Chambers, Butte County Administration Building, Oroville, California; and, WHEREAS, it appearing to said Board that notice of the time and place of the hearing on the petition for the abandonment of the right-of-way in question was duly and regularly given as required by law; and, WHEREAS, testimony and evidence, both oral and documentary, having been produced at said hearing, from which said Board now finds that the hereinafter described public service easement is unnecessary for present or prospective public use. NOW, THEREFORE, IT IS HEREBY ORDERED as follows: I. That the public right-of-way situated in the County of Butte, State of California, as hereinafter more particularly described, is hereby abandoned pursuant to Chapter 3 of Part 3 of Division 9 of the California Streets and Highways Code (commencing with Section 8320) . 2. That said public right-of-way so abandoned is located in the unincorporated area of the County of Butte, State of California, is identified as a portion of the 6th Street and Yolo Avenue rights-of-way adjoining Assessor's Parcels 31-244-01 & 03 in the Thermalito area, and is more particularly described as follows: ~~,~ (~~~ Being a 10 foot strip of those certain 80 foot right of ways known as 6th Street and Yolo Avenue, as shown on Thermalito Wall Map No. 6, in the County of Butte, State of California, more particularly described as follows: Beginning at the point of intersection of the southerly right of way line of the 80 foot right of way known as Yo1o Avenue, with the easterly right of way line of the 80 foot right of way known as 6th Street; thence south along said easterly right of way line, 580 feet, more or -1- ~0-2!515 .~ less, to the south Tine of Block 28 of Thermalito; thence continuing south along said right of way line, 30 feet; thence leaving said right of way line, west, l0 feet; thence north, parallel with said easterly right of way line, 590 feet, more or less, to the beginning of a 30 foot radius curve to the right; thence along the arc of said curve, to a point of tangency with a line 10 feet north of and parallel with the southerly right of way line of Yo to Avenue; thence east along said Line, 430 feet, more or Tess, to the bluff line; thence south along said bluff line, 10 feet, more or less, to the southerly right of way line of Yolo Avenue; thence west along said right of way line, 450 feet, more or less, to the point of beginning. Containing 0.25 acre more or less. EXCEPTING AND RESERVING any existing easements and/or rights at any time, or from time to time, to maintain, operate, replace, remove, renew and enlarge the existing public utility facilities and facilities incidental thereto, including access to protect the property from all hazards, in, upon, and over the highway herewith to be abandoned. 3. That a map showing the right-of-way hereby abandoned is on file in the Office of Butte County Department of Public Works, 7 County Center Drive, Oroville, California 95965. 4. That the Clerk of this Board shall cause a certified copy of this Resolution, with the seal of the Board of Supervisors of the County of Butte, State of California, to be recorded in the office of the Recorder of the County of Butte, State of California.
