RESOLUTION ABANDONING A PUBLIC RIGHT-OF-WAY
PORTION OF BELL ROAD
WHEREAS, this matter came on regularly for hearing before the
Board of Supervisors of the County of Butte, State of California, on
_May 22Y___W__, 1990, in the Board Chambers, Butte County
Administration Building, Oroville, California; and,
WHEREAS, it appearing to said Board that notice of the time and
place of the hearing on the petition for the abandonment of the right-
of-way in question was duly and regularly given as required by law;
and,
WHEREAS, testimony and evidence, both oral and documentary,
having been produced at said hearing, from which said Board now finds
that the hereinafter described public service easement is unnecessary
for present or prospective public use.
NOW, THEREFORE, IT IS HEREBY ORDERED as follows:
1. That the public right-of-way situated in the County of Butte,
State of California, as hereinafter more particularly described, is
hereby abandoned pursuant to Chapter 3 of Part 3 of Division 9 of the
California Streets and Highways Code (commencing with Section 8320).
2. That said public right-of-way so abandoned is located in the
unincorporated area of the County of Butte, State of California, is
identified as a portion of Bell Road at the intersection of Bell Road
and Cussick Avenue, approximately 450' south of the intersection of
Cussick Ave, and Shasta Avenue, Chico, Assessor's Parcel No. 42-59-40,
and is more particularly described as follows:

Being an abandonment of a portion of Bell Court, formerly
known as Bell Road, as shown on that certain map entitled
"Willow Bend Subdivision" as filed for record in Book 116 of
Maps, at Pages 68-71 in the Office of the Butte County
Recorder, situate in Section 16, Township 22 North, Range 1
East, Mount Diablo Basin and Meridian, more particularly
described as follows:
Commencing at the centerline - centerline intersection of
Cussick Avenue and Bell Court, previously known as Bell Road,
as shown on said map, said point of commencement being marked
by a 3/4" iron pipe with a tag not readable;
Thence leaving said Cu sick Avenue and said point of
commencement along said centerline of Bell Court South 89° 05'
00" West, 37.55 feet to the TRUE POINT OF BEGINNING for the
following described property, said Point of Beginning being
located on the southwesterly line of Cu s ick Avenue as shown
on said map;
Thence leaving said Point of Beginning South 37° 53' O1" East,
25.03 feet;
Thence South 89° 05' 00" West, 93.61 feet to the beginning of
a non-tangent curve concave to the West, having a radius of
50.00 feet, to which point a radial line bears South 37° 47'
15" East.
Thence along said curve 46.36 feet, through a central angle of
53° 07' 45";
Thence leaving said curve North 89° 05' 00" East, 43.50 feet
to said southwesterly line of Cusick Avenue;
Thence South 37° 53' 01" East, 25.03 feet along said line to
the Point of Beginning.
Containing 0.06 acre, more or less.
EXCEPTING AND RESERVING any existing easements and/or rights
at any time, or from time to time, to maintain, operate,
replace, remove, renew and enlarge the existing public utility
facilities and facilities incidental thereto, including access
to protect the property from all hazards in, upon, and over
the highway herewith to be abandoned.
3. That a map showing the right-of-way hereby abandoned is on
file in the Office of Butte County Department of Fublic Works, 7
County Center Drive, Oroville, California 95965.
4. That the Clerk of this Board shall cause a certified copy of
this Resolution, with the seal of the Board of Supervisors of the
County of Butte, State of California, to be recorded in the office of
the Recorder of the County of Butte, State of California.
PASSED AND ADOPTED by the Butte County Board of Supervisors this
22nd day of May , 1990, by the following vote:
AYES: Supervisors McInturf, Dolan, Vercruse, Fulton and Chairman McLaughlin
