OLUTION OF THE BUTTE COUNTY BOARD OF SUPERVISORS
INCREASING MUNICIPAL COURT LAW LIBRARY FEES
WHEREAS, this Board of Supervisors is empowered by Section
6322.1 of the Business and Professions Code of the State of
California to increase the Law Library filing fee to not more than
twenty dollars ($20) for each event provided in Sections 6321 and
6322 of the Business and Professions Code, whenever it shall
determine that the increase is necessary to defray the expenses of
the Law Library; and
WHEREAS, this Board of Supervisors is empowered by Section
6322.1, subdivision (c) of the Business and Professions Code to
implement immediately any fee increase adopted by the Board of
Supervisors in 1990 in accordance with subdivision (a) or (b) of
Section 6322.1; and
WHEREAS, prior to the enactment of SB 1609 (Stats. 1990, Ch.
56), any increase in filing fees in civil cases (the major revenue
for Law Library operations) would require a corresponding decrease
in the County General Fund share of such filing fees; and
WHEREAS, SB 1'609 permits the Board of Supervisors to increase
the law library portion of the Superior and Municipal Court civil
filing fees without a corresponding decrease in the County General
Fund share;
NOW, THEREFORE BE IT RESOLVED, that the law library portion
of the filing fee for the North County Municipal Court and the
South County Municipal Court filings shall be and is hereby set at
$20.00 pursuant to SB 1609 (Stats. 1990, Ch. 56), effectuve July
1, 1990.
BE IT FURTHER RESOLVED AND ORDERED that eight dollars ($8.00)
of the increase in the Law Library fee over the Law Library fee
which was in effect on January 1, 1990, is excluded from the
definition of "Total Fee" under Sections 26820.6 and 72055 of the
Government Code.

BE IT Fi3RTHER RESOLVED that a copy of this Resolution shall
be forwarded forthwith to the Judicial Council by the
respective clerk administrators of the Butte County municipal
courts.
PASSED AND ADOPTED by the Board of Supervisors of the County
of Butte, State of California this 5th day of June, 3990 by the
following vote:
