A RESOLUTION REVISING GATE EEES AND HOURS OF OPERATION AT THE NEAL ROAD SANITARY LANDFILL IN BUTTE COUNTY WHEREAS, Neal Road Landfill Company (Contractor) and County of Butte entered into an agreement for operation and maintenance of Neal Road Sanitary Landfill on May 15, 1978; and WHEREAS, Section 12 of the contract provides for a change in cost of doing business whereby the compensation to the contractor shall be increased or decreased in a percentage amount equal to two-thirds (2/3) of the net per- centage change in the consumer price index by either raising gate fees or by other compensation; and WHEREAS, such increased cost of doing business necessitate a 3.52 percent increase in existing gate fees to provide the necessary revenue; and WHEREAS, new legislation including but not limited to Assembly Bill 939 (Sher, et al, Chapter 1095 of the Statutes of 1989) requires extensive changes in solid waste management in the State of California; and WHEREAS, complying with new legislation and requirements will sig- nificantly increase the cost of solid waste management; and WHEREAS, such increased cost of solid waste management necessitate a 6.48 percent increase in existing gate fees to provide the necessary revenue; and WHEREAS, having considered this matter at a public meeting of this Board on June 5, 1990, and having considered oral and written presentations submitted at said meeting, and the data indicating the estimated costs required for solid waste management in accordance with state law having been made avail- able to the public prior to said meetings as required by law, and this Board having found that the proposed gate fees do not exceed such estimated costs; and WHEREAS, Contractor has requested a change in the hours of operation of the landfill to better serve the needs of the solid waste collectors in the county. NOW, 'T'HEREFORE, BE IT RESOLVED by the Butte County Board of Supervisors as follows: 1. That in order to provide a ten percent overall increase in exist- ing gate fees for Contractor's increased cost of doing business and for increased cost of solid waste management, that the gate fees for the operation and maintenance of the Neal Road Sanitary Landfill are established as set forth in Exhibit "A" attached hereto. 2. That the hours of operation be revised to be as follows: I-lours of operation are from 6:30 A.M. to 5:00 P.M., seven days per week, throughout the year, with the exception of the five major holidays of Christmas, New Years, Easter, Fourth of July and Thanksgiving, during which the site is closed. Admittance is not permitted in the final 15 minutes of operation. 3. That this resolution shall be effective on July 1, 1990.
