RESOLUTION AMENDING THERMALITO AREA DRAINAGE FEES
WHEREAS, the Butte County Board of Supervisors has
previously adopted the Master Drainage Plan for the Thermalito
Area of Butte County as recited in Butte County Code Section 20T
210; and
WHEREAS, said Drainage Plan sets forth the facilities
necessary to grovide drainage for said area and provides for
development fees to be adopted by resolution of the Board of
Supervisors; and
WHEREAS, the Board of Supervisors has previously adopted
Resolutions 82-85 and 82-106 establishing drainage fees for the
Thermalito area; and
WHEREAS, said Master Drainage Plan for the Thermalito area
provides for the review and updating of such fees; and
WHEREAS, it is necessary to amend the fees and adjust them
to take into account increases in construction cost levels, as
indicated on Exhibit A.
NOW, THEREFORE, BE IT RESOLVED by the Butte County Board of
Supervisors as follows:
1. The Board of Supervisors makes the following findings
and determinations required by Section 66001 of the California
Government Code in regard to such drainage facility fees assessed
and levied pursuant to Government Code Section 65483 et seq.,
Butte County Code Section 29-210 and this Resolution:
A. The purpose of said fees is to accumulate funds to
construct drainage facilities to eliminate existing flooding and
to assure against future flooding problems as additional
development occurs within the Thermalito area.
B. Such funds shall be used to finance construction of
the drainage facilities identified in the Master Drainage Plan
for the Thermalito Area.
C. The relationship between the type of development and
the feesin question is as indicated on attached Exhibit A and in
said Faster Drainage Plan.
D. Such fees received shall be deposited, invested,
accounted for and expended pursuant to Government Code Section
66006.
BE TT FURTHER RESOLVED that the "Thermalito Drainage Area
Fee Schedule" is hereby amended to read as shown on attached
Exhibit A, effective sixty (60) days following adoption of this
Resolution pursuant to Government Code Section 65962(b).
PASSED AND ADOPTED by the Butte County Board of Supervisors
of the County of Butte, State of California this 7th day of
August, 1990, by the following vote:
AYES: Supervisors Dolan, Fulton, McInturf, Vercruse and
Chairman McLaughlin
