BRRS-Y761(006) BE IT RESOLVED by the Board of Supervisors of the County of Butte, State of California, as follows: 1. That said County approve Program Supplement No. 55 to Local Agency- State Agreement No. 03-5912 for Federal-Aid Projects in Butte County and the Chairman of the Board be authorized to execute said supplement on behalf of said County. Supplement No. 55 covers funding for preliminary engineering costs for the bridge replacement project of constructing the Midway Bridge @ North Fork iiamlin Slough, Bridge Replacement Project No. BRRS-Y761(006). 2. That Clerk of this Board be authorized to attach certified copy of this Resolution to Program Supplement No. 55. This Program Supplement is adopted in accordance with Paragraph 2 of Article TT of the aforementioned Master Agreement under authority of Resolution No. 40-137 approved by the Local Agency an 9/1Fi/90 (See copy attached} . The Local Agency agrees the payment of Federal funds will be limited to the amounts approved by the Federal Highway Administration in the Federal-Aid Project Agreement (PR-2)/Detail Estimate or its modification (PR-2A) or the FNM-Z6, and accepts any increases in Exchange Funds, State Matching funds, and\or Local Agency Funds as shown on the Finance or Bid Letter or its modification as prepared by~the Division of Local Streets and Roads. 2. Right-of-Way and Construction will be programmed as a separate program under Combined Road Plan procedures. 3. In executing this Program Supplemental Agreement, Local Agency hereby reaffirms the 'Nondiscrimination Assurances' contained in the aforementioned Master Agreement for Federal-Aid Program. ~4. Whenever the local. agency uses Federal or State Funds to pay a consultant on a cost plus basis, the local agency is required to submit a post audit report covering the allowability of cost payments for each individual consultant or sub-contractor incur- ring over $25,000 on the project. The audit report must state the applicable cost principles utilized by the auditor in determining allowable costs as referenced in CFR 48, part 31, Contract Cost Principles.
