RESOLUTION OF THE BOARD 'OF SUPERVISORS
OF THE COUNTY OF BUTTE SETTING PARK FACILITY FEES
WHEREAS, the Board of Supervisors of the County of Butte, by
Ordinance Number 2750 adopted on May 23, 1989, added Article IV to
Chapter 16 of the Butte County Code authorizing the assessment and
1•evying of Park Facility Fees on any owner of real property located in
the unincorporated area of the Chico Urban Area adding residential
dwelling units to such property, in order to fund the cost of the
additional park facilities which will be necessary in order to meet
the recreational needs of the new residents resulting from such
developments; and
WHEREAS, the Board of Supervisors by Res. 89T81 adopted May 23,
1989 established the amount of said Park Facility Fees; and
WHEREAS, the Board of Supervisors by Ordinance No. 2863 adopted
on September 18, 1990 amended portions of said Article IV; and
WHEREAS, the Board of Supervisors, by this Resolution, desires
to: amend the amount of said Park Facility Fees, in the manner
provided for in said Article IV of Chapter 16 of the Butte Code;
demonstrate that such fees comply with all of the factors enumerated
in Section 16-30 of said Article and Chapter of the Butte County Code;
and, by reason thereof, confirm that such Park Facility Fees meet each
of the '~nexus" requirements, set forth in Section 66001 of the
California Government Code, all for the reasons set out in Section 16-
27 of said Article and Chapter of the Butte County Code; and,
WHEREAS, the Board of Supervisors has considered this Resolution
at a public hearing, notice of which was given in the manner provided
for by both Sections 54992 and 54994.1 of the California Government
Code ; and
• WHEREAS, the Board of Supervisors has also considered the effect
which the Park Facility Fees will have on monthly housing costs, all
in the manner required by the Butte County General Plan.
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisprs of the
County of Butte as follows:
1. The Board of Supervisors adopts the rark Facility Fees set
forth in Exhibit "A" attached hereto and by this reference
incorporated herein.
2, The Board of Supervisors finds that the Park Facility Fees
adopted by this Resolution comply with the requirements of Section 16-
30 of the Butte County Code, entitled "Amount of Park Facility Fees",
all for the reasons set forth in the document entitled "Basis for and
Amount of Park Facility Fees", a copy of which is attached hereto,
marked Exhibit "A" and by this reference incorporated herein,
3. The Board of Supervisors confirms that since said Park
Facility Fees adopted by this Resolution comply with the requirements
of Section i5-30 of the Butte County Code, such fees also meet each of
the "nexus" requirements set forth in Section 66001 of the California
Government Code, all for the reasons set out in Section 16-27 of the
Butte County Code, entitled "Findings".
~, In accordance with the provisions of Section 65962 of the
California Government Code, this Resolution as well as the Park
Facility Fees provided for herein, shall not become effective until
the 61st day following its adoption; provided, however, that if for
any reason Ordinance Number 2863 adopted by the Board of Supervisors
on Sept. 18, 1990, should not become effective, then this Resolution
similarly shall not become effective.
PASSED AND ADOPTED by the Butte County Board of Supervisors this
18th day of September, 1990, by the following vote:

BASIS FOR AND AMOIINT OF PARK FACILITY FEE
I. BASIS FOR FEE
A, Assumptions: (Based on the Park and Recreation Plan ("Plan"~
of the Chico Area Recreation and Park District):
- 5.0 acres of improved park land per 1,000 people as
follows:
A. .9 acres/1000 people for neighborhood park facilities
" Park Size: 5-10 acres
Separate and in conjunction with school sites
B. 1.6 acres/1000 people for community park facilities
Park Size: 20 acre minimum
C. 2,5 acres/1000 people for lineal park facilities
including:
1. Creekside greenways
. 2. Trail systems
B. Census information:
-- 2,29 people per residential unit according to the 1980
Federal Census.
C. Estimated cost of Park Development
Land Cost - unimproved $46,000 per acre
Park Facility Improvement Cost $37,500 per acre
Public Off-Site Improvements $20,300 per acre
TOTAL 0 , 0 per acre
II. PARK FACILITY FEE
Calculation: Improved Acreage
$103,800/acre times 5.0 acres/1000 people = $519,000
1,000 people divided by 2.29 people/unit = 436.68 units
$519,000 divided by 436.58 units W $1189/unit
ITT. APPLICABILITY
The fees set forth herein shall apply as to building permit
applications submitted on or after November 19, 1990.
