FIXING THE MUNICIPAL COURT
FILING FEES IN ACCORDANCE WITH GOVERNMENT CODE
SECTION 68090, 72055, 72056, AND 72056.5
WHEREAS, Government Code Section 68090 provides that
within the 90-day period preceding each odd-numbered year following
1981, the Board of Supervisors may fix the amounts to be charged
as total filing fees in the courts within the county pursuant to
Sections 26820.4, 26826, 26827, 72055 and 72056 and establish the
components thereof, far the succeeding two-year period; and
WHEREAS, Government Code Section 72056.5 authorizes an
adjustment for any two-year period not to exceed 6 percent; and
WHEREAS, Government Cade Section 68090 requires that such
fees be fixed by resolution and that a copy of such resolution be
promptly forwarded to the Judicial Council.
NOW, THEREFORE, BE IT RESOLVED that the following fee
schedule shall be and is hereby adopted for the Municipal Court of
Butte County:
(a) Civil complaint $50
(b) First paper by party other than plaintiff $35
(c) Papers transferred from another court $40
BE IT FURTHER RESOLVED, that the filing fee components
shall be and are hereby adopted as follows, effective January 1,
1991:
(a) County $22
(b) Law Library $20
(c) Judges retirement $ 2
(d) Micrographics/automation fund $ 3
(e) Alternate dispute resolution $ 3
PASSED AND ADOPTED this 18th day of December, 1990 by the
Butte County Board of Supervisors by the following vote:
