HomeMy WebLinkAbout903ORDINANCE N0. 903 1 2 3 4 5 si 7 8 9 10 I1 12 1.3 14 i 15 16 17 18 19 20 21 22 I I 23 24 25 26 27 28 29 30 31 32 I AN ORDINANCE ZONING A PORTION OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, AURSUANT TO ORDINANCE NOS. 475,522 and 676 OF SAID COUNTY AND AMENDING ORDTNANCE NO. 606 OF SATD COUNTY The Board of Supervisors of the County of Butte, State of Cali- fornia, under and pursuant to Ordinance IVo. 475 of said County as amended by Ordinance Nos. 522 and 676 and amending Ordinance No. 60i of said County, Do Ordain as follows: SECTION 1. The hereinafter described area situate in the County of Butte, State of California, shall be and is hereby zoned as a "C-1" (Light Commercial) District as hereinafter described and subject to all of the restricted uses applicable to the uses of a "C-1" bistrict, said area so zoned being located south of the City of Orovilie, particularly described as follows: As shown by map attached (AP 36-172-05)and as shown on Butte County Sectional Map (Vo. 4F, Lot l2 of Hill 'N Dale Subdivision, Unit 1, as shown in the office of the Butte County Planning Commission and in the office of the Butte County Clerk SECTION 2. The following restrictions shall apply in a °C-1" (Light Commercial} District: 2.1 Uses permitted: a. Multiple dwellings and dwelling groups, subject to the height limit, building site area, average lot width and yard re- quirements specified for "R-3" Districts. b. Hotels, clubs and lodge halls, hospitals, sanitariums and clinics. c. Retail stores and shops of a lignt commercial character and conducted within a building, including appliance stores, banks, barber shops, beauty parlors, book stores, cleaner or laundry agents and launderettes, dress shops, drug stores, food stores, furniture stores, millinery shops, professional offices, restau- rants, refreshment stands, service stations, shoe shops, storage garages, studios and tailor shop-s; public utility commercial office: and other uses which are of similar character to those enumerated and which will not be detrimental or obnoxious to the neighborhood in which they are to be located. 2.2 The fallowing uses subject to securing a use permit in each case: a. All uses permitted in "R-1" and "R-2" Districts. b. Automobile courts and trailer camps. c. Public and quasi public uses. d. Animal hospitals, auto sales, dance academies or halls, open air retail sales, theatres, pet shops, wholesale stores or storage, undertaking establishments, used car sales, used or second- hand goods and other uses which are of similar character. 2.3 Building Height Limit required: Forty-five (45) feet. 2.4 P7inimum Lot bfidth required:',Twenty-five (25) feet. x 2 3 4 5 6 7 8 9 10 11 12 13 14 15 i6 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 . 2.5 F"runt Yard required: Same as required by Butte County Setback Ordinance No. 506. 2.6 Side Yard required: None, except where the side of a lot abuts upon the side of a lot in an "R" District, in which case the abutting side yard shall be rrot less than five (5) feet, and except where the side yard on the street side or a corner lot abuts on an "R" District, in which case the side yard on the street side shall be one-half the corresponding front yard required in such "R" District. 2.7 Rear Yard required: Twelve (12) feet, or five (5) feet adjacent to an alley. 2.8 Any use for which a use permit is required in an "A-2" District, upon application far and granting of a use permit. SECTION 3. All uses of land within the District not specifical1~ authorized and permitted under Section Z, are prohibited. SECTION 4. Penalti-es for any violation of the zoning hereby im- posed within the District shall be as provided in the Zoning Enabl- ing Ordinance. In compliance with the provisiong of the Zoning Enabling Ordinance, this Ordinance shall from and after its effect- ive date become a supplement to and par6 of the Zoning Enabling Ordinance. SECTION 5. This Ordinance shall be and it is hereby declared to be in full force and effect from and after thirty (30) days after the date of its passage; and before the expiration of fifteen (15) days after its passage this Ordinance shall be published once with the names of the members voting for and against it in the oroville Mercury , a newspaper published in the County of Butte, State of Galifornia.
