HomeMy WebLinkAbout9061 2 3 4 5 e 7 8 9 10 11 7.2 13 14 15 16 17 18 19 2a 2I 22 23 24 25 26 27 28 29 30 31 32 ORDINANCE N0. -~~ _- AN INTERIM ORDINANCE REGULATING THE USE OF LAND AND THE CONSTRUCTION AND USES OF BUILDINGS ALONG THE SKYWAY The Board of Supervisors of the County of Butte does ordain as Follows: SECTION 1. The Board of Supervisors finds that certain regu- lations are necessary for the preservation of the public health, safety, convenience and general welfare, and hereby adopts certain such regulations: Said area 5o zoned is described by map attached and on file in the Office of the Butte County Planning Commission and in the Office of the Butte County Clerk. SECTIOtV 2. REGULATIONS: 2.1 The provisions of this Ordinance shall apply to all property lying on each side and within three hundred and fifty (350) Feet of the centerline of the Skyway as shown by Road Survey No. =.A.S. 757, which area is hereinafter referred to as the "District" end shall be subject to the following regulations: 2.2 Uses permitted: The following uses are permitted within all parts of the "District": a. Lawful uses of land now established. b. Single-Family dwellings and accessory buildings. c. Agricultural uses and buildings. d. The following, upon the securing of a Use Permit in each particular case: Schools, churches, public buildings, public utility buildings and structures, roadside stands for the sa]e of produce from the lands fronting on the highway within the "District". 2.3 Additional uses permitted: Certain additional uses are permitted within all parts of the "District", upon the securing of a Use Permit. The additional uses are highway service uses primarily for the convenience of the traveling public, and include: a. Gasoline Service Stations. b. Restaurants. c. Motels and tourist accommodations. d. Quasi-public halls and buildings. SECTION 3. ADDITIONAL REGULATIONS: 3.1 The following regulations apply in all parts of the 'District". a. Building Line: No building or structure shall hereafter be located within the "District" closer than fifty-five (55) feet from the centerline of the Skyway. 2 3 4 6 6 8 9 10 11 i2 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 b. Building Site Area: Each single-family residence shall be located on a site not less than eight thousand, one hundred and twenty-five (8,125) square feet in area and there shall not be more than one family residence per each 8,125 square-feet, and said residence shall be located not less than six (6) feet from each side line of the building site. 3.2 In cases where compliance with the provisions of this section will result in undue hardship, a variance may be approved in the manner prescribed for the handling of Use Permits. SECTION 4. USE PERMITS: Application for a Use Permit shall be made to the Board of Supervisors, who shall refer it to the Planning Commission for a recommendation, and such applications shall include a description of the requested use, and shall be accompanied by plans showing the locations and elevations of proposed buildings, or proposed alterations, locations of driveways and parking areas, advertising matter and structures, and other information which may be required by the Board of Supervisors. The Board of Supervisors shall act upon such application following receipt of a recommendation from the Planning Commission within forty (40) days from the date of filing of the application. When deemed advisable, a public hearing, notice of which will be given, may be hold on Use Permit applications by the Planning Commission. SECTION 5. The Penalties for violation of the zoning hereby imposed upon said "Qistrict" shall be as provided in the said Zoning Enabling Ordinance. SECTION 6. This Ordinance shall be, and it is hereby declared to be in full force and effect from and after the date of its passage, pursuant to the emergency hereinafter found and declared; and it shall remain in full force and effect until such time as a permanent ordinance covering the above-described area shall take effect, following notice, public hearings and such other procedures as are provided in said Zoning Enabling Ordinance, ar until such time as the Board of Supervisors shall determine that the said area shall not be zoned. SECTION 7. -For the immediate preservation of the public peace, health and safety of the area hereinabove described, and the resi- dents and inhabitants thereof, it is necessary that this ordinance take effect immediately. A declaration of the facts constituing the necessity therefor is as follows: The adoption of such Interim Zoning Plan is necessary in the public interest, to maintain the status quo in such district pend- ing the determination of the application for such permanent detail zoning. SECTION 8..
