HomeMy WebLinkAbout910ORDINANCE N0. 910 AN ORDINANCE ZONING A PORTION OF TIE COUNTY OF 1 BUTTE, STATE OF CALIFORNIA, PURSUANT TO ORDINANCE NOS. 475, 522 and 676 OF SAID COUNTY, AND 2 REPEALING ORDINANCE N0. 691 3 The Board of Supervisors of the County of Butte, State of Cali- fornia, DOES ORDAIN as follows: 4 That Butte County Ordinance No. 691 is hereby repealed 5 as follows: ;6 SECTION ]. The hereinafter described area situate in~~the County of Butte, State of California, shall be zoned as an A-R (Agricul- ;? tural Residential) District, as hereinafter described and subject t all of the restricted uses,applicab]e to an "A-R" District, said ar $ so zoned being located in 'the Community of Paradise, California, pa titularly described as follows: 9 Butte County Sectional Map No< 6-A as shown in la the Office of the Butte County Planning Commission and in the Office of the .Butte County -Clerk 11 SECTION 2. The following regulations shall .apply in an "A-R" '12 District: 13 2.1 Uses permitted: 14 a. One (1) family dwellings, not including tents or trailers, 15 b. Accessory buildings pertinent to the permitted uses. c. Agricultural uses, and ''16 d. Livestock, subject to requirements as follows: 17 1) Minimum lot area to be devoted to residential use shall be not less than eight thousand, one hundred twenty-fig ~$ (8,125.} square feet, 2) Exclusive of the area devoted to the residential ' 19 use, the following lot or parcel areas shall be required for each animal raised or kept on the premises: 20 a) For each horse or head of cattle over one (1) year of age - eight thousand,. one hundred twenty-five (.8,125) 21 square feet. b) For each head of swine over ten (1O) weeks of age 22 eight thousand, one hundred twenty-five (8,125) square feet. c) For each .head of sheep or goats - Two thousand 23 (2,0000 .square feet. '24 2.2 The following uses subject to securing a use permit in. each case: 25 a. Duplex dwellings and multiple family dwellings, 26 b. Golf courses, country clubs, if permitted, would perm accessory uses such as driving range, pro shop, cocktail bar 27 restaurant. c. Public and quasi-public uses including churches, fire 28 houses, hospitals, parks and playgrounds, schoo]s and public utility buildings. '29 d. Commercial poultry farming and livestock farming. e. Veterinary clinics, outpatient, 30 f. Nurseries and plant gardens.- 31 2,3 Minimum building area required - eight thousand, one hundred twenty-five (8,125) square feet. 32 2.4 Minimum building site width required _ sixty-five (65) feet. 2.5 Minimum front yard required -.fifty (50) feet from the center line of the road, as r_ 1 2.6 Minimum side yard requirement - five (5) feet. 2 SECTION 3. In addition to the uses permitted and authorized under Section 2, and solely within that portion of the district 3 hereinafter specified, "C-1" (Light Commercial) uses may be per- . mitted subject to the securing of a use permit in each case: 4 a. Land within a radius of five hundred -(500) feet from the 6 intersection of Pentz Road and Wagstaff Road and having frontage on Pentz Road, the depth shall not exceed three hundred and fifty 6 (350) feet on each side of the centerline of said Pentz Road. 7 b. Land within a radius of five-hundred (500) feet from the intersection of Pentz Road and Bille Road and having frontage on 8 Pentz Road, the depth shall not exceed three hundred and fifty (350) feet on each side of the centerline of said Pentz Road. 9 3.1 In addition to the uses permitted and authorized-under 10 Sections 2 and 3, and solely within that portion of the district hereinafter specified, "R-4" (Maximum-Density Dwellings, Restricted 11 Service) uses shall be permitted for the area so delineated in Section 1 (Assessor Parcel 53-14-22 and Assessor Parcel 53-24-28), 12 subject to securing a land use permit from the Planning Commission and approval by the Board of Supervisors in each case, as follows: 13 a. Professional and Business Offices. 14 b. Medical-Dental Clinics. c. Medical and Dental Offices. 15 d. Hotels and Motels, including restaurants. e, Mobile Home Parks, for which the area shall not be 16 less than three (3} acres. f. Fraternity and Sorority Houses. 17 g. Hospitals, except for emergency and small animal. h. Multiple dwellings. 18 SECTION 4. All uses of land within the District not specificall lg authorized and permitted under Sections 2 and 3 are prohibited. '20 SECTION 5. Penalties for any violation of the zoning hereby im- posed within the District shall be as provided in the Zoning Enabling 21 Ordinance. In compliance with the provisions of the Zoning Enabling Ordinance, this Ordinance shall from and after its effective date 22 become a supplement to and a part of the Zoning Enabling Ordinance. 23 SECTION 5. This Ordinance shall be and it is hereby declared to be in full force and effect from and after thirty (30} days after the 24 date of its passage, and before the expiration of fifteen (15) days after its passage this Ordinance shall be published once with the 2g names of the members voting for and against it, in the 1~~,,;.:~:e~ Paradise Post a newspaper published in the County of Butte, tote f 'fig Ca ifornta. 27 PASSED and ADOPTED by the Board of Supervisors of the County of 7 Butte, State of California, this loth day of January 19 ~ '2g by the fallowing vote: 29 AYES: Supervisors Dunaway, Maxon, McKillop, Pryde and Chairman Howsden 30 NOES: None 3j.
