HomeMy WebLinkAbout91-022_ ~ a.~~-- ~- ~~- ~~~j ~~ BOARD~OF SUPERV[SORS '* ~ ~ `~ ;`'}+ COUNTY OF BUTrE, STATE OF CALIFORNIA. s • •"N .~l~. ~ ~ Resolution 2Vo. 91_22 RESOLUTION EXCHANGING REAL PROPERTY AND ACCEPTING GRANT DEED AND AUTHORIZING CHAIRMAN TO SIGN WHEREAS, the Board of Supervisors of the County of Butte, State of California, declares its intention to exchange that real property described in Exhibits "B" and "C", attached hereto, for that certain easement described in Exhibit "A", attached hereto; and WHEREAS, that said real property described in Exhibits "B" and "C" attached hereto, is owned by the County of Butte and is designated ad Daly Avenue but in lieu of the contemplated exchange not necessary for the public or county use; and WHEREAS, that said real property described in Exhibit "A", attached hereto, is necessary for the public use as a right-of-way; and WHEREAS, the property interests to be exchanged is of equal value; and WHEREAS, the Board desires to exchange said property pursuant to Section 8356 of the Streets and Highways Code, of the State of California, NOW THEREFORE, BE IT RESOLVED by the Board of Supervisors of the County of Butte as follows: 1. That the Board vacates the existing Daly Avenue right-of-way as described in Exhibits "B" and "C", pursuant to Section 8330 of the Streets and Highways Code. 2. That the Board hereby pursuant to Section 8356 of the Streets and Highways Code authorizes the exchange of the real property described in Exhibits "B" and "C" attached hereto, and incorporated herein as if set forth in full, for that certain easement shown in Exhibit "A", which is attached hereto and incorporated herein as if set forth in full. 3. That the Board of Supervisors by acceptance of said easement described in Exhibit "A" does not accept said road for maintenance and said road is not accepted into the County road system. 4. That the Chair is authorized to sign Quit Claim Deeds in favor of Browns Valley Land and Cattle Company No. 3, A California Limited Partnership and Rosetti - Scala #i, A California Limited Partnership as to the real property described in Exhibit "B" and in favor of Leroy H. Schieler and H. Joyce Schieler as to the real property described in Exhibit "C", and the Chairman is further authorized to accept a Grant Deed from Browns Valley Land and Cattle Company No. 3, A California Limited Partnership in favor of the County of Butte as to that certain easement described in Exhibit "A". .PASSED AND ADOPTED by the Board of Supervisors of the County of Butte, State of California this _, 26th day of Fehruary 1991.
