RESOLUTION GIVING NOTICE OF HEARING ON PETITION
TO ABANDON A PUBLIC UTILITY EASEMENT
LOCATED ON LOT 281, BELLY RIbGE ESTATES UNIT ONE
WHEREAS, this Board has received a petition from five or
more free-holders, requesting the abandonment of a public utility
easement as described below, and at least one of the petitioners
is a resident of the township in which said public utility
easement is situated; and
WHEREAS, pursuant to Chapter 3 of Part 3 of Division 9 of
the California Streets and Highways Code, commencing with Section
8320, this Board shall set a date, hour and place for a hearing
on the petition for abandonment.
NOW, THEREk'ORE, BE IT RESOLVED by the Board of Supervisors:
1. That this Board hereby gives notice that at its
regular meeting on I~~ay 7 1991, at 10:45 a.m. , in the Board
Chambers, Butte County Administration Building, 25 County Center
Drive, Oroville, California, a hearing shall be held to hear all
persons interested in the abandonment of that certain public
utility easement located in the unincorporated area of the County
of Butte, State of California and is more particularly described
as follows:
Being that certain 10 foot Public Utility Easement
lying within a portion of the east 1/2 of Section 1,
T19N, ROE, MDM as shown on the map of Lot 281 of Kelly
Ridge Estates Unit One, recorded in Book 38 Maps of
Record at pages 5 through 10, County of Butte, State of
California, more particularly described as follows:
All that property in said Lot 281 located within 10
feet of the following described line:
Beginning at the most southerly corner of said Lot 281
thence 60 degrees 30' 00" E, 119.15 ft. to the most
easterly corner of said Lot 281, and the end of the
herein described line,
Excepting therefrom the northeasterly 20 feet lying
within the building setback line, lying parallel with
and contiguous to the southwesterly right of way line
of Greenbrier Drive, as shown on said Subdivision Map.
2. That a map, showing the public'utility easement to
be abandoned is on file in the Office of the Butte County
Department of Public Works, 7 County Center Drive, Oroville,
California 95965.
3. That at the conclusion of said hearing the Board
intends to abandon said public utility easement.
4. That this abandonment proceeding is being conducted
pursuant to Chapter 3 of Part 3 of Division 9 of the California
Streets and Highways Code {commencing with Section 8320).
5. That this Resolution be posted and published
pursuant to the provisions of Chapter 3 of Part 3 of Division 9
of California Streets and Highways Code.
