~~.eraa'i•-' RESOLUTION ABANDONING A PUBLIC UTILITY EASEMENT
LOCATED ON LOT 281, KELLY RIDGE ESTATES UNIT ONE
WHEREAS, this matter came on regularly for hearing before
the Board of Supervisors of the County of Butte, State of
California, on $;~y 7 1991 in the Board Chambers, Butte County
Administration Building, Oroville, California; and,
WHEREAS, it appearing to said Board that notice of the time
and plane of the hearing on the petition for the abandonment of
public utility easement in guestion was duly and regularly given
as required by law; and,
WHEREAS, testimony and evidence, both oral and documentary,
having been produced at said hearing, from which said Board now
finds that the hereinafter described public utility easement is
unnecessary for present or prospective public use.
NOW, THEREFORE, IT IS HEREBY ORDERED as follows:
1. That the public utility easement situation in the
County of Butte, State of California, as hereinafter mare
particularly described, is hereby abandoned pursuant to Chapter 3
of Part 3 of Division 9 of the California Streets and Highways
Code (commencing with Section 8320).
2. That said public utility easement so abandoned is
located in the unincorporated area of the County of Butte, State
of California and is more particularly described as follows:
Being that certain 10 foot Public Utility Easement lying
within a portion of the east 1/2 of Section 1, T19N,
R4E, MDM as shown on the map of Lot 281 of Kelly Ridge
Estates Unit One, recorded in Book 38 Maps of Record at
pages 5 through I0, County of Butte, State of
California, more particularly described as follows:
All that property in said Lot 281 located within 10 feet
of the following described line:
Beginning at the most southerly corner of said Lot~281
thence 60 degrees 30' 00" E, 119.15 ft. to the most
easterly corner of said Lot 281, and the end of the
herein described line.
Excepting therefrom the northeasterly 20 feet lying
within the building setback line, lying parallel with a
contiguous to the southwesterly right of way line of
Greenbrier Drive, as shown on said Subdivision Map.
3. Tha a map showing the publi utility easement
hereby abandoned is on file in the Office of Butte County
Department of Public Works, 7 County Center Drive, Oroville,
California 95965.
4. That the Clerk of this Board shall cause a
certified copy of this Resolution, with the seal of the Board of
Supervisors of the County of Butte, State of California, to be
recorded in the office of the Recorder of the County of Butte,
State of California.
PASSED AND ADOPTED by the Butte County Board of
Supervisors this 7th day of May 191, by the
following vote:
