RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY
OF BUTTE AFFIRMING THE PLANNING COMMISSION'S ACTION
REGARDING GREEN ROCK QUARRY
WHEREAS, on March 28, 1991, the Butte County Planning Commission
rendered a decision to modify Condition 50 of Use Permit 83-40 to extend the expiration
date under the Use Permit to July 31, 1991; and
WHEREAS, Friends of Table Mountain tunely filed an appeal of this decision
to the Butte County Board of Supervisors; and
WHEREAS, the applicant, Roger Green, filed a final application on January
4, 1989, for modification of an existing Use Permit for a quarry. The modification was to
include the extension of a the period of operation of the mine; and
WHEREAS, hearings before the Planning Commission were duly noticed
pursuant to Butte County Code Section 2~4-46 and government Code Section 65090; and
WHEREAS, the Planning Commission held hearings, the latest of which was
on March 28, 1991; and
WHEREAS, an EIR for the quarry was approved by the Board of Supervisors
on Nevember 13, 1983; and
WHEREAS, A short term (3 months) extension of the existing Use Permit will
not involve new significant environmental impacts not considered in the certified EIR for the
orcgucal Use Permit; and
WHEREAS, the short-teen extension of time is not so substantial as to require
modi,~cations to the existing EIR, and, therefore, no subsequent or supplemental
environmental review is required;
WHEREAS, granting of a short-terrre (3 months) extension of time is made in
order to maintain the status quo of continued mining operations under the existing use permit
at Green Rock Quarry pending the County's final decision on the pending use permit
application for along-term extension of time; and
WHEREAS, good cause, therefore, exists to support the short-term extension
of time;
NOW, THEREFORE, BE IT RESOLVED as follows:
1. The Board hereby finds and determines that the foregoing recitals are
true and correct
2. The action of the Butte County Planning Commission of March 28,
1991, modifying Condition 50 of Use Permit 83-40 to extend the
expiration date under the Use Permit to July 31, 1991, is hereby
affirmed.
3. The appeal by Friends of Table Mountain is hereby denied.
PASSED AND ADOPTED by the Butte County Board of Supervisors on this
21st day of May, 1991, by the following vote:
AYES: Supervisors McIntur~, McLaughlin and Fulton
