HomeMy WebLinkAbout91-064RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF BUTTE RECOMMENDING, APPROVING AND SUPPORTING CHANGES IN PENDING ASSEMBLY BILL RE: CHANGES IN BUTTE COUNTY MUNICIPAL COURT SYSTEM WHEREAS, certain changes have been made as to salaried positions in the Butte County Municipal Court system affecting the Government Code Sections listed below. It is recommended that said sections be amended as follows: PROPOSED LEGISLATION FOR THE BUTTE COUNTY MUNICIPAL COURTS SECTION 74937 OF T$E GOVERNMENT CODE BE AMENDED TO READ: "The clerk/administrator of the North Butte County Municipal Court may appoint the following positions: (a) one assistant clerk/administrator or one supervising court clerk. (b) Three supervising court clerks. (c) Nine court clerks II/III, or office assistant III. (d) Four court clerks I/II, or office assistant I/II. (e) One senior account clerk, or account clerk." "The clerk/administrator of the South Butte County Municipal Court may appoint the following positions: (a) One assistant clerk/administrator or one supervising court clerk. (b) Two supervising court clerks, or court clerk II/III, or office assistant III. (c) Three court clerks II/III, or office assistant III. (d) Six court clerks I/II, or office assistant I/II. (e) One senior account clerk, or account clerk." SECTION 74940 OF THE GOVERNMENT CODE BE AMENDED TO READ: "Whenever reference is made to a range number in this section of this article, the schedule of biweekly salaries shall be that -2- as set forth in the Butte County Salary Ordinance. (a) Clerk/administrator range 211 (b) Assistant clerk/administrator range 160 (c) Supervising court clerk range 140 (d) •Court clerk I range SO (e) Court clerk Ii range 100 (f) Court clerk III range 120 (g} Office assistant III range 69 (h) Office assistant II range 49 (i) Office assistant T range 29 (j) Senior account clerk range 74 (k) Account clerk range 54 (1) Court reporter range 202 SECTION 74935.6 BE ADDED TO THE GOVERNMENT CODE TO READ: "C. The board of supervisors shall, by ordinance, specify the salary rates for official court reporters in Butte County. In addition to the aforementioned compensation, the County shall provide necessary supplies for official court reporters." WHEREAS, in adopting this resolution, the Board of Supervisors of Butte County recognizes and acknowledges that the resolution constitutes a "local request" as defined by and within the meaning of Government Code Section 17556 (a) and that Butte County is therefore precluded from obtaining any reimbursement of any resultant costs from the state under Section 6 of Article XIII B of the California Constitution. NOW, THEREFORE, BE IT RESOLVED by the Butte County Board of Supervisors that the above-cited recommendations of amendments to the Government Code are approved, the Board supports the amendments as indicated, and accepts the responsibility for funding of said changes. -3 - PASSED AND ADOPTED by the Butte County Board of Supervisors this 4th day of June 1991, by the following vote: AYES: Supervisors McInturf, P1cLaughlin, Fulton and Chair Dolan NOES: None ABSENT: PJone NOT VOTING: None OLAl~', Chair, Butte County of Supervisors ATTEST: WILLIAM H.
